Dear Copeland Borough Council,

I am writing to make an open government request for all the information to which I am entitled under the Freedom of Information Act 2000. The request follows FOI 12010.

1. A detailed breakdown of services and resources provided to nugen and Sellafield Ltd for the PPAs disclosed in FOI 12010. Information to include man hours and resources by service area, including planning and others where involved.
2. Head of Planning and Place was disclosed in FOI 12010 as responsible for PPAs. Sellafield Ltd have disclosed the CEO and Head of Nuclear Energy. Provide information on their role negotiating PPAs in place of Head of Planning. Include copies of job profiles and backgrounds.

Thank you for your request for information regarding the PPAs disclosed in FOI 12010:

Request:
1. A detailed breakdown of services and resources provided to nugen and Sellafield Ltd for the PPAs disclosed in FOI 12010. Information to include man hours and resources by service area, including planning and others where involved.

I can advise that the information requested is as follows:

1. Please see the attached spreadsheet and following notes:
- The 2 numbers in green are the amounts quoted as cost recovery in the Council's previous response to the FOI request. The data contained in the spreadsheet is as accurate as we can be. Unfortunately part of the back-up data was lost during a large scale cyber-attack that severely affected the Council in 2017/2018. This is the reason why the calculations for the time and costs fall slightly short in both instances.
- The majority of the costs recovered for the Nugen PPA related to external project lead provided by an external consultancy.

2. The Head of Planning and Place confirms that this PPA together with the Nugen PPA was negotiated by the CEO and Head of Nuclear Energy rather than the Head of Planning and Place. The Head of Planning and Place was directly responsible for negotiating the other PPAs quoted relating to specific planning projects as set out on the original FOI response.

Section 40(2) FOI Act - Personal Information
Details relating to Copeland Borough Council's staff is personal data as it relates to identifiable individuals therefore the exemption that applies is S40(2), by virtue of section 40(3)(a) of the FOI Act (Personal Information).
Section 40(2) in an absolute exemption in cases where disclosure would breach any of the GDPR Principles.
Whilst it is appropriate to disclose some information relating to job roles, there is no similar expectation that personal details including specific job profiles relating individual staff members would also be released into public domain as a result of being released under a Freedom of Information request. Job profiles are advertised when a role is vacant however once occupied, the information can lead to the identification of an individual and amounts to personal information.

In accordance with S17(1) of the Freedom of Information act 2000 this note acts as a refusal notice for this part of your request.

I am writing to request an internal review of Copeland Borough Council's handling of my FOI request 'Planning performance agreements'.

Many councils publish job profiles for senior managers, including their CEO.

PPAs involving these large sums of money should be backed by detailed calculations for the work involved in cost recovery. This information must be held somewhere. How many copies were held before the cyber attack?
