*The nature and specific details of these reports/claims.
*How the cases was allocated against the HDC's enforcement policy and tier attributed.
*How the cases were considered specifically against the enforcement COVID policy and the trigger for an onsite visit.

*The conclusions of the cases and a copy of the closeout details.

Thank you for your request for information 202002135 [REF/Lq/19/XZ/D7/]
dated 31 December 2021 requesting information about all details of any
enforcement cases against, The Garth, Warburn, Glenavon, Four Winds and 34
, Garbutts Lane, Hutton Rudby. Please accept my apologies for the late
response.

Please be aware that as you are requesting environmental information the
Council has processed your request as an ‘Environmental Information
Regulations’ request as opposed to a Freedom of Information Request. This
is because environmental information is exempt from disclosure by virtue
of Section 39 of the Freedom of Information Act 2000. 

Some of the requested information constitutes the personal data of third
parties and as such is exempt from disclosure and has been redacted from
the documents by virtue of Section 12(3), 13(1) and 13(2) of the
Environmental Information Regulations 2004 (amended by Schedule 19(307) of
the Data Protection Act 2018), where disclosure would breach one or more
data protection principles specified by Section 5(1) of the General Data
Protection Regulation (GDPR). In this case we consider that disclosure
would breach the first principle, namely that personal information must be
processed lawfully, fairly, and in a transparent manner in relation to the
Data Subject. In this case we consider that the disclosure would be unfair
and none of the conditions for processing, listed in Articles 6 and 9 of
the GDPR, would be met.

All exceptions prescribed by the Environmental Information Regulations are
‘qualified exceptions’ which means that their application are subject to
the Public Interest Test which I have conducted accordingly. It is
considered that disclosure of some correspondence would identify the
complainant (s).

Having considered the public interest, the Council’s decision is therefore
to withhold the information at this time. 

Please find attached the Council’s information governance appeals
procedure for your information. Please remember to quote the reference
number above in any future communications.

  I have sought to answer the information requested in your questions
below:

The number of reports/claims made against the properties and the dates of
these.

Two allegations made in respect of the property of Glenavon only on 25
June 2020 and 29 October 2020

*The method and number of claims which were reported (ie, phone, email
etc).

As above, both by email.

*The nature and specific details of these reports/claims.

Removal of neighbouring hedge and

Part removal of domestic hedge

*How the cases was allocated against the HDC's enforcement policy and tier
attributed.

The cases were prioritised in accordance with the Council’s Local
Enforcement Plan as attached as category 4 cases because planning
permission has been granted and the hedges are domestic hedges rather than
countryside field boundaries.

*How the cases were considered specifically against the enforcement COVID
policy and the trigger for an onsite visit.

The council do not have an adopted ‘enforcement COVID policy’ A decision
is made at a point in time as to whether it is appropriate to visit the
site having regard to the national tier of lockdown in place and whether
the alleged breach can be seen from the public domain without need to
enter into a property or private land having regard to the ability to
socially distance and the circumstance of individual property owners
and/or complainants.
