Dear Merton Borough Council,

Thank you for such a prompt response to the request for information on live enforcement cases in Merton. It is disappointing to learn of the poor state of the database used to manage the enforcement caseload.

Nevertheless, may I confirm my request as simply seeking a basic list of the live enforcement cases in Merton. Ideally, this would be broken down by ward and start date and provide a postcode but if any or all of this additional information is not (yet) available then a simpler list would be welcome.

I am aware of the report that is provided to Merton's Planning Applications Committee. This provides a tracker of the number of existing, new and closed cases. It is the information needed to inform this report to the Committee that is the subject of this request. The July Committee was informed that there are 608 current enforcement cases - this request is to ask where they are.

Please will you confirm this information can be made available.

Yours faithfully,

Tony Burton

Dear Merton Borough Council,

Please pass this on to the person who conducts Freedom of Information reviews.

I am writing to request an internal review of Merton Borough Council's handling of my FOI request 'Planning enforcement cases'. There has been no response to my request in reply to the initial response that this information is not available and more than 20 days have passed.

A full history of my FOI request and all correspondence is available on the Internet at this address: https://www.whatdotheyknow.com/request/p.... This sets out the rationale for maintaining the request to know the location of the live enforcement cases whose numbers are regularly reported to Merton Council's Planning Applications Committee.

Yours faithfully,

Tony Burton

Dear Mr Burton,

Thank you for your email.

In accordance with section 10(1) of the Freedom of Information Act 2000, most public authorities may take up to 20 working days to respond, counting the first working day after the request is received as the first day.

You may wish to refer to guidance available on the ICO's website, at this link: https://ico.org.uk/media/for-organisatio...

Your Freedom of Information Act request received by the Council on 20 July 2017 (ref SRQ-94157-T2M8H1) therefore had a response due date of 18 August 2017. This request was, however, responded to on 21 July 2017.

The Council considers that your initial request has been answered by either confirming that information is not held, providing you with the information requested, or explaining why any information has been withheld and the reasons for any redaction.

Your subsequent and clarified request, which was received by the Council on 24 July 2017 (ref SRQ-95694-R3J5L0) has a response due date of 22 August 2017.

That request is currently under consideration by relevant management staff, within the Council's planning enforcement team.
