Dear Yorkshire Dales National Park Authority,

I’m seeking details of enforcement action taken by your authority’s planning team in relation to properties offered for short-term lets via platforms such as Airbnb.

Please could you provide the following under the Freedom of Information Act:

The number of planning enforcement notices issued by your authority in relation to short-term lets in each financial year from 2011/12 to 2018/19.

The number of planning contravention notices issued by your authority in relation to short-term lets in each financial year from 2011/12 to 2018/19.

If available, please also provide the number of informal warnings issued by your authority’s planning team in relation to short-term lets in each financial year from 2011/12 to 2018/19.

Good morning.  Thank you for sending a request for information

 

However, we require clarification as to what you actually want.  Your
request is not clear;  are you asking for details of PCNs and/or
enforcement notices issued in relation to properties where there is
inappropriate use for example where letting (whether short term or longer
term) is being carried out without the necessary planning permission?  (In
many cases where permissions are given to residential uses, conditions
applied to restrict the type of use eg to holiday lets are through the
application of legal s106 agreements etc). 

 

In cases where properties are being let, either with or without the
necessary permissions, we would not be in a position to determine (or
indeed would have no reason to need to know) the means by which let
properties were marketed, whether by AirB&B, other online platforms, or
through letting agents, or through local media etc.  We would not
therefore be able to provide any information on the use of “platforms such
as

Air B&B which was specifically mentioned in your opening line. 

 

This being the case, I will await further information from you before
auctioning the provision of any information.   If you can provide details
of what you wish to know, your request will be considered under the terms
of Environmental Information Regulations. The timescales required by EIR
(20 working days) will therefore not begin until I have this information.

Thank you for your email, and I acknowledge receipt of your request for information.

Your request will be handled by an officer who will respond under the terms of Environmental Information Regulations 2004 as appropriate.

In some circumstances a fee may be payable and, if that is the case, we will let you know and will require payment of this charge before we proceed to deal with your request:

The Authority is entitled to charge for disbursements - photocopying, printing and postage, plus any charges incurred in recovering documents from storage/archive. Copying charges are currently 7p per A4 page, 17p per A3 page, and £1.50 for a CD, plus the actual postage. If the charge would total less than £2.00, the information will be provided for free.

Additionally, under EIR, we may make a charge for the cost of staff time in locating, retrieving and extracting that information, at a rate of £25 per hour.

You will receive the requested information within 20 working days, unless the Authority does not hold the information or there is a reason for it to be withheld, in which case we will let you know within this timescale.

Whilst the Authority is happy to provide information wherever possible, you should be aware that there are a number of exemptions to the provision of information under the terms of the Freedom of Information Act 2000, or exceptions under the Environmental Information Regulations 2004.
