Planning Enforcement

Response to this request is long overdue. By law, under all circumstances, Wychavon District Council should have responded by now (details). You can complain by requesting an internal review.

Dear Wychavon District Council,

The property
Winterfell
Bricklehampton
Evesham
Worcestershire
WR10 3HJ

Was the subject of a planning appeal Ref: APP/H1840/C/17/3177567 on 8th February 2018.

The outcome was that the enforcement notice requiring the occupant to:

1. Permanently cease the use of the land for the siting of a mobile home for
residential purposes;
2. Permanently remove from the land the mobile home, decking and any domestic
paraphernalia including two trampolines and return the land to its original use,
that of agricultural use;
3. Permanently remove from the land any utilities, pipework, cables, sewerage
connections associated with the residential use of the land and return the land to
its original use, that of agricultural use.
4. Permanently cease the use of the land for equestrian purposes and permanently
remove from the land the wooden field shelter;
5. Permanently cease the use of the land for the commercial tree surgery business
and permanently remove from the land all logs and waste associated with the
tree surgery business.

was upheld, but the time limit to comply increased from 4 months to 9 months.

It has now been 23 months since the original enforcement notice was issued and 14 months since the appeal decision, but no enforcement action has been taken.

Can you please provide copies of all documents (Memos, Meeting Minutes, Reports From The Enforcement Team, or Other Council Departments, and any emails) relating to the discussions surrounding the decision not to take any enforcement action.

Can you also provide an analysis of the total costs incurred to date in connection with this breach of planning regulation and the subsequent appeal.

Yours faithfully,

James Hickman
