Hertfordshire County Council recently released details of planning application PL\0866\17 on to their planning portal (https://cloud1.atriumsoft.com/HCCePlanni...). In the list of documents included is the 'Neighbour consultation address list - 829 addresses in total.xls'.

Under the Freedom of Information act 2000 and/or Environment Information Regulations 2004, I request the following information:
- Details of the decision making process which identified the list of consultees

2) Communications about the petition

The 'Reconsider the decision to build a new Harpenden School on the Site East of Common Lane' petition (https://www.change.org/p/hertfordshire-c...) was submitted to Hertfordshire County Council on the 12th June 2017.

Under the Freedom of Information Act 2000 and/or the Environment Information Regulations 2004, I request the following information:
- All Hertfordshire County Council internal communications (emails, meeting minutes, etc) relating to the petition from the submission date until present relating to the petition

Dear Information Governance,
By law Hertfordshire County Council should have replied promptly to my information request (https://www.whatdotheyknow.com/request/p... )and by 27 October latest - they have failed to do so. I am writing to the main FOI contact at HCC to make a formal complaint about this matter which is extremely urgent as we are in the consultation period of a planning application which has a strict deadline for response.

I would like to apologise for the delay with this response and any
inconvenience it has caused. Your request for information has been
considered under the Environment Information Regulations 2004. I can
confirm that Hertfordshire County Council does hold  the information you
have requested and can respond as follows:

 

1)    Details of the decision making process which identified the list of
consultees.
Hertfordshire County Council (HCC) does not hold this information as HCC
are not involved in determining consultees to a planning application.

 

2)    All Hertfordshire County Council internal communications (emails,
meeting minutes, etc) relating to the petition from the submission date
until present relating to the petition.

Please find the attached documents. Please note some emails within these
documents may be duplicated.

 

Please note some information is exempt from disclosure under Section 40(2)
of the Freedom of Information Act 2000, relating to third party personal
data.  The disclosure of names and addresses would contravene the first
Data Protection principle due to none of the conditions in Schedule 2 of
the Data Protection Act being satisfied.  As a result we are unable to
disclose this information.

 

Names of more junior members of staff have also been removed from the
enclosed documents in line with Hertfordshire County Council practice. 
The County Council has decided that names of junior members of staff
should be withheld under the exemption contained in Regulation 12(3) and
13 of the Environmental Information Regulations Act, relating to personal
data.

 

You are entitled to access the personal data held by the County Council,
as part of your rights under the Data Protection Act 1998 and this data is
provided to you on that basis.
