Information Regulations 2004.  Owing to the quantity and complexity of the
information you have requested we have not be able to provide the
information to you by 23^rd March 2018, which would be within twenty
working days and therefore need to extend the deadline as indicated
below. The regulations allow for an extension under these circumstances.

Content of the consultation responses received by HCC in respect of the
Planning Application Ref PL/0866/17 extends to several hundred pages, and
much of the content will need to be considered against the exceptions
contained within the Environmental Information Regulations 2004.

 

We will respond to your request as quickly as possible, and by 24^th April

I am writing to request an internal review of Hertfordshire County Council's handling of my FOI request 'Planning Application: PL/0866/17 - Consultation'.

I am dissatisfied because HCC has failed to respond within the allowed time, despite having moved the deadline to suit HCC's preferred timeframes during the history of the FOI request. I will refer this complaint to the ICO if HCC fails to conduct the internal review adequately within 20 days.

On 26^th February 2018 we received the following request for information

Please may I have full details and content of the consultation responses
received by HCC in respect of the Planning Application Ref PL/0866/17.

 

Your request for information has been considered under the Environmental
Information Regulations 2004. I can confirm that Hertfordshire County
Council does hold  the information you have requested and can respond as
follows:

 

Three days (22.5 hours)have already been spent examining documents to
consider whether any exemptions need to be applied to the information
requested and we believe there would be an approximate further 14 hours to
continue. We were not aware of how large the documents were and how long
it would take to make relevant redactions until the task was in hand.

 

In the circumstances, the Council seeks to rely on the exception under
Regulation 12(4)(b) – manifestly unreasonable. In applying this exception
the Council is required to apply the public interest test.

 

The factors in favour of disclosure are:

 

·         Disclosure will promote the accountability and transparency of
the County Council with regard to the decisions it takes;

·         Disclosure would allow individuals to better understand
decisions made by the County Council which affect their lives, and may
encourage public debate.

 

The factors against disclosure we have considered are:

 

·         The County Council would be required to undertake an
unreasonable amount of work which would divert from its core business.

·         There is a very strong public interest in public authorities
being able to carry out their wider obligations fully and effectively so
that the needs of the communities they serve are fulfilled.

 

On balance, it is considered that it is not in the public interest for the
County Council to carry out the additional work necessary to answer your
request as the public interest in carrying out its core business is not
countered by at least equally strong arguments in favour of disclosure.

 

If you would like to receive the documents that have been considered
 under Environmental Information Regulations 2004 we can provide this for
you.

 

If you would like us to continue considering the remainder of the
information a new request would need to be made after 60 working days of
your previous request has been made.

Apologies for any confusion on how we need to work this, however these are the steps we need to take following the terms of the Environmental Information Regulations.

EIR/ENV/02/17/15045 - has now been closed and this was refused on the terms of being manifestly unreasonable.

To receive the information that has already been worked on we are required to raise a separate request, which I will do under separate cover, dated 29th May 2018. This would then be the last request made by yourself regarding the same subject, so the 60 working day will be from 29th May 2018, please see below;

Guidance from the Information Commissioners Office, states “The Commissioner considers that the implication of the original estimate remaining valid is that the refined request becomes a new request. This means that the statutory time for compliance commences on the date of the receipt of that new request.” Taken from Section 64, Requests where the cost of compliance exceeds the appropriate limit 20150909 Version: 1.2.
