Dear Copeland Borough Council,

This planning application has been submitted on behalf of Energy Coast West Cumbria Limited. Certificate A claims that the land is owned by that company. My Company search indicates that the land is owned by Energy Coast West Cumbria (Properties) Limited. See here

If that is correct then this does not seems to be a valid planning application.

If this information is correct then the agent appears to have offended against s65 of the Town and Country Planning Act 1990. A company can be liable for the acts of its agent.

Assuming that the company search information is correct -

1. Please provide such information as the Council has to why it validated this application

2. Please provide such information as the Council has as to the action it will take where the certificate annexed to the application is invalid. If it is invalid then the application should of course be rejected. There is an option to prosecute subject to consideration of the appropriate factors as guided by the CPS.

3. The Mayor is a Director of both the applicant company and the apparent owner of the land. He was nominated to those companies by the Borough Council and it should then hold details of the two Company's activities. I assume that the Borough Council should then hold documentation indicating just which company is the land owner . Please confirm that the Borough Council did hold such information as to the identity of the beneficial land owner prior to this application being submitted.

4. Assuming that you did have such prior knowledge of the identity of the land owning company, and that is the "(properties)" company rather than the applicant please provide information as to how this application got validated

5. If you hold information which indicates that my company search information is incorrect then please provide a copy of the evidence
