2) Any correspondence between Savills (which is the agent representing the public authority) and the production company or its representatives, between 1 October 2020 and 30 November 2020.

In considering the public interest in this case, please include consideration of the fact that this planning application has not yet been determined at the time of this request.

This request has been handled under the Freedom of Information Act 2000. 
I can confirm that Buckinghamshire Council does hold information falling
within the description specified in your request.  Please find the
relevant details 

Request

1)      Any documents which explain the reasons why planning application
20/07719/R9FUL was submitted by Buckinghamshire Council Property & Assets
Directorate rather than directly by the production company and/or the
production company's representatives.

The planning application was submitted by the Council as landowner,
because the benefit of the consent runs with the land and when originally
submitted, was for a period of 3 years (subsequent to submission, the
period was reduced to 6 months).

2)    Any correspondence between Savills (which is the agent representing
the public authority) and the production company or its representatives,
between 1 October 2020 and 30 November 2020.

Savills have confirmed there has been no correspondence between themselves
and the film company on behalf of the Council between 1st October 2020 and
30th November 2020. Therefore this information is not held.

2) Whether the council has authorised or permitted installation of CCTV systems on the site. If so, please provide the name of the organisation or company operating any CCTV system.

3) The name and address of the production company which is carrying out filming activity on Spade Oak Quarry.

In considering this request and the balance of the public interest, please note that the planning application for extension of filming from 1 May to 1 November has not yet been determined.

concerning filming activity on Spade Oak Quarry.

 

This request has been handled under the Freedom of Information Act 2000. 
I can confirm that Buckinghamshire Council does hold information falling
within the description specified in your request.  

Request

1) The arrangements which are in place for the council or its
representatives and agents to monitor filming activity on Spade Oak
Quarry.

The Council’s Property & Assets team maintain regular contact with the
Film company and their notification system to keep local residents
informed.

2) Whether the council has authorised or permitted installation of CCTV
systems on the site. If so, please provide the name of the organisation or
company operating any CCTV system.

The Council has not installed CCTV. The Council understands that the Film
company has not installed CCTV.

3) The name and address of the production company which is carrying out
filming activity on Spade Oak Quarry.

We believe that this information is exempt under Section 43(2) – Prejudice
to commercial interests.

In this case the interest of the Council would be prejudiced as it
involves disclosure of information which we do not have consent to release
and would likely cause damage to the Council’s commercial reputation.
Furthermore it would prejudice the film company as it would likely damage
their commercial interests. Who and what is filming is considered to be
commercially sensitive and disclosure might be a security risk to the
production.

Section 43 is a qualified exemption and subject to the public interest
test.

Generally speaking there is a public interest in the disclosure of
commercial information in order to ensure that there is transparency of
public funds and the Council's activities are conducted openly. However
there is no public interest in the Council disclosing information that may
damage to the Council’s commercial reputation, which would in turn
prejudice the Council’s commercial interests. Filming is a commercial
activity and, while we recognise the public may be interested in this, it
is not in the public interest to prejudice the film company and their
activities by releasing any further details.

The Council works in an open and transparent way. All Council spending is

any planning applications can be challenged through the appropriate
routes, including any application for the extension of filming. We have
answered your previous request for information and have also supplied
information for this further request. However, the Council consider that
any public interest in transparency around the disclosure of this
information is outweighed by the public interest in avoiding damage to the
commercial interests of the Council and the film company.
