Planning Application 15F/0516 – Countryside Properties (UK) Ltd

The Planning Case Officer’s report dated 4th March 2015, submitted to the Liverpool City Council Planning Committee, recommended approval of the above application subject to a S106 legal agreement. The application was subsequently approved and formal planning permission granted by LCC on 9th October 2015

In the Officer’s report, under the sectional heading S106 Agreements, it was noted that under the Liverpool Unitary Development Plan (OE14 – Open Space in new residential developments) ;

“Where suitable provision of open space cannot be met on site, the Council will seek a financial contribution towards a package of improvements to existing recreational open space, to meet local needs and to mitigate for any increased demand upon the existing open space resource generated by the development. “

… the Head of Planning does not consider that it would be appropriate in this instance to insist upon on-site provision

“The developer contribution in this instance would be £200,000.”

“Under the provisions of the Community Infrastructure Levy Regulations, the Council is required to identify appropriate mitigation for a nearby facility to address the impacts of the development.”

“Officers from Planning and Parks and Greenspaces are currently carrying out an appraisal to determine which local facility is most likely to be under pressure from occupiers of the development and this will be set out in the wording of the Legal Agreement.”

I request

1. A copy of the above mentioned Planning and Parks and Greenspaces appraisal for the subject site (along with any referenced supporting documentation)

2. Confirmation that the applicant has paid the said £200,000 to LCC

3. A detailed breakdown of how the said £200,000 has actually been spent (or allocated if not yet spent)

Thank you for this response.

It is disappointing to learn that there has been no written assessment, as without such a document it is unclear how the Council has determined the impact of the development upon existing local recreational open space.

In the absence of any written assessment, I would be obliged if you would arrange to furnish the following information.

1. The methodology used by the responsible Council Officer to determine the impact of the development site upon recreational local space.

2. Details of which other recreational local facilities (i.e. closer to the development site than Calderstones Park) have been reviewed for impact and the result thereof.

3. Indicate whether these s106 funds are “ring fenced” or if they are considered to have now been pooled into a “general” expenditure fund.

4. If the funds are ring fenced, the name of the Lead Council Officer responsible for recommending how the remaining funds are to be expended.

Following verbal discussions with the responsible Council FOI Officer (Angela Lewis) I have decided it would be futile to pursue this specific request any futher.
