Planning application 1/21/9004
Dear Cumbria County Council,
I make this request under the Environmental Information Regulations 2004.
At the Development Control and Regulation Committee meeting on 12 October 2022, the Development Control Manager said, in reference to the public consultation expiry date of planning application 1/21/9004:
"That remained on the website until the 5th October when it was pointed out to us that ... oh sorry, we had a ... we felt the need to consult Natural England on the biodiversity matter, so we gave Natural England until 11 October to make comments to us. Unfortunately that reconsultation meant the website date was changed to 11 October."
This information request relates to this reconsultation of Natural England referred to above, the response(s) to this reconsultation (if any) and the Council's assessment of any Natural England's response(s) (or lack of response).
1. Please provide the relevant request(s) made to Natural England regarding the reconsultation referred to above.
2. Please provide Natural England's response(s) to the request(s) shown in 1 above. Please include any attachments (if present) to any emails.
3. Please provide information held by Cumbria County Council that shows the Council's assessment of 1/18/9006 as amended by 1/21/9004 in light of the information (or absence of information) described by point 2 above. Please include internal emails relevant to this assessment. Any previous assessments of 1/18/9006 as amended by 1/21/9004 prior to the request in 1 above do not need to be included.

Thank you for your request for information regarding Planning application
1/21/9004, which was received on 17/10/2022.
The council aims to provide you with the information within the statutory
timescale of 20 working days in this case the date is 11/11/2022.
Subject to the information not being exempt or containing any references
to third parties.
The council will, as a matter of routine make information available in
electronic format. Where it is not practical to do this information will
be provided in hard copy (paper). If information is required in
alternative formats e.g. language, audio, large print, etc., please
indicate this as soon as possible so the council can consider your
request.
The Environmental Information Regulations 2004 define a number of
exemptions/exceptions which may prevent information being released to you
automatically. The council will make an assessment about the application
of any exemptions/exceptions and issue you with a decision letter, which
will include details of your right to appeal.
If the information you request contains reference to a third party the
council will consult with them prior to making a decision about the
release of information.
In accordance with the council's Charging Policy a fee may be charged for
supplying information. If a fee is payable you will be issued with a fees
notice. The applicable fee must be paid in full before the information is
processed and released. The statutory time limit for responses is
suspended until the council has received and processed your payment. If
payment is not received within three months of issuing the fees notice
your request will be closed.
