Dear Yorkshire Dales National Park Authority
Please can you disclose how many reports/complaints the authority receives annually regarding potential breach of planning and/or enforcement issues.
Of the reports/complaints received how many cases have resulted in the Authority taking formal enforcement action.
It is preferable that the information is provided on an annual basis for the years 2014-2019

Good morning. Thanks for your email which I will forward to the enforcement team for processing. You should expect a response within twenty working days which takes us to 26 January 2021 (we are closed over the Christmas period). Your request will be handled by an officer who will respond under the terms of the Environmental Information Regulations 2004.

In some circumstances a charge may be payable and, if that is the case, we will let you know and will require payment of this charge before we proceed to deal with your request:
The Authority is entitled to charge for disbursements - photocopying, printing and postage, plus any charges incurred in recovering documents from storage/archive. Copying charges are currently 7p per A4 page, 17p per A3 page, and £1.50 for a CD, plus the actual postage. If the charge would total less than £2.00, the information will be provided for free.
Additionally, under EIR, we may make a charge for the cost of staff time in locating, retrieving and extracting that information, at a rate of £25 per hour.

You will receive the requested information within 20 working days unless the Authority does not hold the information or there is a reason for it to be withheld, in which case we will let you know within this timescale.
Whilst the Authority is happy to provide information wherever possible, you should be aware that there are a number of exceptions under the Environmental Information Regulations 2004. These may prevent the Authority from releasing all or some of the information you have asked for. You will be informed if this is the case and we will explain why we have withheld the information.

Environmental Information Regulations 2004 (EIR) and the figures you
requested are outlined below relating to enforcement cases received and
the figures where formal enforcement was taken:

 

2014    127 cases        3 had action authorised at committee

2015    127 cases        7 had action authorised at committee

2016    117 cases        2 had action authorised at committee

2017    130 cases        6 had action authorised at committee

2018    126 cases        2 had action authorised at committee

2019    119 cases        3 had action authorised at committee

 

Environmental Information Regulations 2004 (EIR):  The Environmental
Information Regulations 2004 give a right of access to information held by
the Authority relating to the status of the elements (such as air, water,
land/ landscape) and factors that may affect these elements; as well as
measures (including administrative measures) such as policies, plans,
programmes and activities that are likely to affect these elements;  or
reports and analyses on the implementation of environmental legislation

Right of appeal

 

If the Applicant is not happy with the Authority’s response to a request
for information he may, within 40 working days of receipt of this
response, ask for an internal review by contacting the Access to
Information Officer (email [1][email address] or
telephone 01969 652326).   The request for review must be in
writing/email, and should clearly set out the reasons for the
dissatisfaction.

 

If having completed the Authority’s internal review procedure the
Applicant remains unhappy with the response, he or she may refer the
matter to the Information Commissioner’s Office:

Please can you confirm if the figures presented include tree preservation orders? If this is the case, would it be possible to itemise how many of the total reports and cases with action autherised relate specifically to tree preservation orders.
