Plain clothes enforcement
Dear Wirral Metropolitan Borough Council,
With regards to Enforcement services carried out on your behalf by Kingdom can you please answer yes or no the following questions.
1) Are Kingdom authorised by WBC to carry out their environmental enforcement duties, and issue FPNs, for the offence of littering wearing plain clothes/not in an identifiable uniform?
2) Are Kingdom authorised by WBC to carry out their environmental enforcement duties, and issue FPNs, for the offence of failing to clean up after dog fouling wearing plain clothes/not in an identifiable uniform ?
3) ) Are Kingdom authorised by WBC to carry out their environmental enforcement duties, and issue FPNs, relating to smoke free offences wearing plain clothes/not in an identifiable uniform?
If you have answered "yes" to 1 or more of these questions could you please provide a link to the legislation/government or defra guidelines permitting this use of covert surveillance.

2) Are Kingdom authorised by WBC to carry out their environmental
enforcement duties, and issue FPNs, for the offence of failing to clean up

3) ) Are Kingdom authorised by WBC to carry out their environmental
enforcement duties, and issue FPNs, relating to smoke free offences
wearing plain clothes/not in an identifiable uniform? - YES
If you have answered "yes" to 1 or more of these questions could you
please provide a link to the legislation/government or defra guidelines
permitting this use of covert surveillance.
Kingdom enforcement officers are permitted to dress in plain clothes for
the purpose of issuing of fixed penalty notices for littering / dog
fouling and other enforcement matters.
Neither the Environmental Protection Act 1990 nor The Dogs (Fouling of
Land) Act 1996 prescribes that an authorised officer must be uniform in
order to issue a fixed penalty notice when an offence has been witnessed.
