PIRC report 00653/17

Under PIRC's consideration of Police Scotland's handling of my complaint 1 the Commissioner acknowledges in para 2 page 4 that Police Scotland's Chief Inspector wrote to me the following:
"You should also be aware that local officers were previously given legal advice about the situation at [named location] and the matter of enforcement action in respect of the gate placed across the road.”
From the information you hold please confirm that advice, as described by your Chief Inspector exists and if so please tell me the status of the person giving that advice. For instance, was that advice formally received from a legal entity or from or via an ordinary citizen or perhaps a police officer or something else?
For clarity I do not wish to see the advice nor do I seek its contents, nor do I seek the name of the person issuing the advice if it exists: my aim is to establish if that advice truly exists or if there is any evidence it ever existed and to get some idea whether it was/is of sufficient gravitas for the Chief Inspector to rely upon it as he does within the consideration of my complaint.
If PIRC has not seen that advice then, from the information you hold can you tell me if it was requested by PIRC .

Although this is a prima facie refusal it confirms that Police Scotland hold the information outlined in the Chief inspectors complaint report which PIRC critisiced in their unpublished report. That is an important confirmation that the Chief inspector probably followed incorrect legal advice and thus the blame very possibly lies with the author of that advice.
