PIP Face to face dispute

The request was refused by Department for Work and Pensions.

Dear Department for Work and Pensions,What action does the DWP take when a claimant disputes what was said and what happened in a face to face assessment .Does your department inform ATOS and CAPITA asking them to address the issue . Does your department keep records of the number of claimants who have cited this in their reasons for a mandatory reconsideration and also included this as part of their appeal . Do you al;so keep records of the number of claims where the assessment provider has scored nil points in the descriptors but the decision maker at the DWP has disagreed and awarded points before the mandatory reconsideration stage .

Yours faithfully,

barbara sunley

Dear Department for Work and Pensions,

Please pass this on to the person who conducts Freedom of Information reviews.

I am writing to request an internal review of Department for Work and Pensions's handling of my FOI request 'PIP Face to face dispute'.
It has been refused on the grounds that it would cost over 600 pounds . one person working for three and a half days does this mean that everybody in the department earns over 855 pounds a week .Could you explain how you arrive at this figure

[ GIVE DETAILS ABOUT YOUR COMPLAINT HERE ]

A full history of my FOI request and all correspondence is available on the Internet at this address: https://www.whatdotheyknow.com/request/p...

Yours faithfully,

barbara sunley

Hello,

You may find this information from the Information Commissioners office to be of help regarding the cost limit on FOI requests - https://ico.org.uk/for-organisations/gui...

The figure of £25/hour is enshrined in Regulation 4(4) of "The Freedom of Information and Data Protection (Appropriate Limit and Fees) Regulations 2004" http://www.legislation.gov.uk/uksi/2004/... - so to use the assumption of a 7 hour working day it would only take a little under three and a half days to hit the limit of £600.

It might be possible to get the information you need be restricting the search criteria, e.g. to a particular region, to a particular timeframe or some other criteria which limits the overall search - the DWP are obliged to offer assistance/advice under Section 16 of The Act, so should be able to clarify which criteria may allow the, to produce a responsive document - it is worth noting however that it is unlikely they will do this as part of their internal review automatically - you may need to follow-up with them in order for this assistance to be rendered (albeit, it should have been offered already in respect of recorded information - they may not interpret questions that require an answer to be formulated as something covered by FOI as s that isn't necessarily "recorded information") http://www.legislation.gov.uk/ukpga/2000...

Hope this is of some help.
