PIP and ESA entitlement - EU residents

The request was partially successful.

Dear Department for Work and Pensions,

My FOI Act request concerns a claimant’s entitlement to PIP and ESA in EU countries post 1 January 2021.

Are British nationals residing in the EU still entitled to be paid the daily living component of PIP post this date?

Are they still entitled to be paid ESA?

In addition, please would you provide the relevant regulations governing an ESA applicant’s entitlement to obtain a mandatory reconsideration of an ESA decision. What redress is available to a Claimant in the event that no mandatory reconsideration is forthcoming?

Finally, please will you provide the relevant regulations and caseworker guidance concerning a PIP and ESA Claimant’s entitlement to these benefits when seeking medical treatment in an EU country.

Yours faithfully,

A. Tonge
