I acknowledge receipt of your email of 16/08/2023 expressing
dissatisfaction with our response to your request for information
(dated 07/08/2023), which was handled under the Environmental
Information Regulations 2004.
We will be dealing with this by way of an Internal Review in
accordance with the procedure outlined in our response dated
07/08/2023. Folkestone & Hythe District Council's approach to such
matters is subject to guidance produced by the Information
Commissioner's Office in line with Regulation 11 of the Environmental
Information Regulations 2004 and the EIR Code of Practice.
Regulation [1]11(1) of the Environmental Information Regulations
2004 outlines the scope of the internal review procedure. This reads
as follows:
“[…] an applicant may make representations to a public authority in
relation to the applicant’s request for environmental information if
it appears to the applicant that the authority has failed to comply
with a requirement of these Regulations in relation to the request.”
Consequently, the scope to be considered by a review is whether the
Council’s response on 07/08/2023 breached the relevant regulations.
In evaluating this, the case will be examined anew, taking into
account the points and evidence raised during your request. In the
interest of ensuring your arguments are examined comprehensively and
fairly, please can you confirm if the below understanding is correct?
• You believe that your EIR request was not answered correctly. We
stated that no information was held, as the Council had not given
instructions to Cinque Ports Pest Control for Pigeons in
properties on Littlestone Seafront since 01/01/2018; but you
believe that the Council has given instructions that fall within
these parameters.
We anticipate that the internal review will be completed within 20
working days of your application for review, however in exceptional
circumstances it may take slightly longer. If this is the case with
your enquiry, then we will endeavour to notify you and explain why
more time is needed.

FHDC supplied as part of a response to a SAR with a copy of a letter received from Cinque Ports Pest Control Ltd but with large parts redacted such that it was a pointless exercise sending it but as part of the SAR the Council must do so.

I refer to your application dated 07/08/2023 for an internal review of the
council’s decision on your request under the Environmental Information
Regulations 2004. Your request for an internal review was as follows:
• You believe that your EIR request was not answered correctly. We
stated that no information was held, as the Council had not given
instructions to Cinque Ports Pest Control for Pigeons in properties on
Littlestone Seafront since 01/01/2018; but you believe that the
Council has given instructions that fall within these parameters.
In considering your request I have looked at the case impartially and
reconsidered the relevant factors. In light of this, I can confirm that I
consider the original handling of the case to be justified. I will address
each point in sequence and explain my rationale as follows.
• You asked a very specific question about if the Council had instructed
a certain pest control company to destroy, trap or remove pigeons from
properties on the Littlestone seafront since 01/01/2018: “what
instructions, if any, FHDC has given to Cinque Ports Pest Control Ltd
to trap, poison or otherwise remove feral pigeons from properties in
Littlestone (Sea Front) since 1st January, 2018 with the dates of
those instructions.”
• Information Officers approached the Environmental Services Team who
confirmed that they had not instructed this company to carry out any
work, either before or after the date you gave.
• As part of my own investigation, I bypassed Environmental Services and
performed a search through the SalesForce system that they work
through. I also instructed our IT Services Team to run an archive
search on all emails sent to and from the
@cinqueportspestcontrol.co.uk domain.
• The findings of my searches showed that the Council contacted Cinque
Ports Pest Control for the first time in July 2022 to obtain a quote
for preventing and discouraging pigeons from nesting on two
properties. It was stressed by Environmental Services that they did
not want the birds to be destroyed, and trapping/removing them was not
discussed.
• You stated that you had received information surrounding this pest
control company in a recent information request, but upon reviewing
this it looks to be the same emails surrounding an initial quotation
that I found in my searches.
• There has been no further contact with this company since the Council
requested these costs, and no instruction to carry out any work has
been given to them. I therefore do not uphold your complaint and
maintain that your EIR request was answered in the correct manner by
Information Officers.
