I am writing to make an open government request for all the
information to which I am entitled under the Freedom of Information
Act 2000.

Normally it wouldn't be a problem to have a quarterly organigram.

However with the high turnover of senior staff -including Dame Julie Mellor and her deputy, as well as the director of investigations sudden departure it's had to know exactiy who is in control at the PHSO.

And complaints might wish to write to senior officers, at least they are in with a chance if they have the right name - as often correspondence seems to go into the Black Hole of Millbank .

Yes you do need an individual member of staff's name...enough ignoring of correspondence goes on as it is.

At least with a name, complainants know who is responsible for ignoring them.

It's a ridiculous situation. The deputy has resigned and the investigations head has mysteriously vanished.

And yet the PHSO will not allow complainants to know who is running the PHSO.

Dame Julie Mellor Has also resigned.

How arrogant.

The PHSO now re-defining my request .....and nannying me by telling me what I should have requested, instead if what I did.

And I tried the suggested route above for a whole YEAR - before the external investigator decided that the PHSO had entirely botched my complaint - about its inability to understand the complaint.

Apology from Dame Julie Mellor and £500.

If I'd stuck with the ' contact our email address' system- my justified ( as it turned out) complaint would have continued to reside in the waste paper bin.

As it is, the PHSO is failing to respond within 20 days when complainants use the address above,

But the real question is wHy is the PHSO so secretive about its top managers?

The public pay their salaries - and so are entitled to know who the responsible offices are.

So much for the PHSO's openness and transparency.

And when I've stated that I can't open the link, I've been rather snappily told 'you ought to be able to open it' previously.

That particular bit of ' I can't -you can ' correspondence went on for ages, with Ms Gasston implying that I was basically rather stupid for not being able to read it.

Fortunately, I could then add it to the evidence in FOIA Tribunal court, which helped me win my case,.

The Tribunal judge commented that I had done well to act as patiently as I had.

( I think that is part why the the PHSO lost..the attitude came through) .....because it's no use claiming vexation - when the PHSO is more vexing than the requester).

'Frustration plus determination does not equal vexatiousness' .

This is how it ended ..Tribunal Decisions don't usually seem to make this open criticism the organisations harassing requesters, but it was justified by the arrogance shown.

Last paragraph refers to the PHSO harassment of me including this incident - and subsequent inept cover up - even though the PHSO still refuses to accept that any took place -(of course).

 'The Appellant clearly was not getting satisfaction nor the meaningful response she deserved.

 'This  Tribunal reminds itself that every is the duty on Public Authorities to assist members of the public in formulating and processing their requests.

'On hearing the appellant on the facts of this case we are all the view that more could have been done to assist the processing of this request.

'That this was a request with a genuine purpose was acknowledged by the Respondent but this Tribunal adds  that the Appellant has satisfied that the need for her persistence,  in its various forms as it transpired on the facts is justified by the failure of the Public Authority to respond more comprehensively, effectively,  efficiently or adequately.

 'Further if there were any perceived harassment or such distress then the burden for such,  in our considered view,  cannot be placed entirely on the Applicant or her request.

Really, I cannot fathom how the PHSO operates.

It must have the names and designations of its senior officers somewhere on file.

How do its officers know how to communicate with rhe correct officers. Especially with a 24% turnover in staff.

If it's not in the form of an organigram, then I am quite happy to receive any other list.

So why Is the PHSO being so secretive?

The public pays £37m a year for the PHSO, why isn't it entitled to know who is running it?

Logically, the data must be held within HR.

Overspending
Parliament authorised a Net Cash Requirement limit of £31,716,000 and an Annually Managed Resource Expenditure limit of minus £25,000 for the PHSO. The outturn against these limits was £31,991,000 and £4,638,000 respectively. This means that the authorised limits were breached by £275,000 for Net Cash Requirement and £4,663,000 for Annually Managed Resource Expenditure and so I have qualified my opinion on the Parliamentary and Health Service Ombudsman’s 2014-15 financial statements in these respects. HM Treasury proposes to ask Parliament to authorise a further £275,000 of Net Cash Requirement and £4,663,000 of Annually Managed Resource Expenditure.

The two qualifications identified in my audit highlight the need to ensure a step change in financial management within PHSO. Following my identification of these financial control issues PHSO has taken active steps to review and address weaknesses in its financial management. It is important these encompass improvements in the quality and skills of the finance staff, improve financial reporting to enable the Board to have sufficient oversight of financial performance and that greater attention is paid to the review process to ensure the presentation of accurate financial data and adequate resource bids. The planned actions being taken by PHSO include these areas, and are referenced in the Governance Statement.
I will review the PHSO’s progress in addressing these weaknesses in financial reporting and financial management in my future audits.

4. Staff responsibilities
4.1 PHSO has a corporate responsibility to identify and respond to requests for information as efficiently as possible, and within the statutory deadlines. It is the responsibility of all PHSO staff to identify and take appropriate action on information requests as soon as they are received. Thank you but no .. you have already supplied that information.

Since you gave the assurance that the PHSO organigram is updated on a 'quarterly basis' , the requests for senior officers names were those which had been replaced in the meanwhile - and due to go into the next quarterly organigram - October 5 , as the the organigram is the scope of the request.

So I don't understand why you would redirect me to the July organigram again, which is now clearly outdated, as, due to its openness and and transparency policy , will have already provided the next quarterly chart on its internet site.
Which was due on October 5.

But it appears to be missing.

So could I have the link to the October 5 organigram please?

Clearly the PHSO has misinformed me. Therefore it is reasonable that a proper explanation of why the PHSO is stating this should be produced quarterly ( October 5) on its website, then I am assured that it will be given in a response ....and then it still is apparentky unavailable, should be given.

In addition, the names of the senior officers in the organigram were present in HR data when I asked for them, since no recent organigram was available.

Could you therefore explain why S22 applies to data ALREADY held on record by the PHSO 's HR department, or explain why the PHSO doesn't keep the names of its senior officers - organigram or not- within its data.

Dear Parliamentary and Health Service Ombudsman,

Please pass this on to the person who conducts Freedom of Information
reviews.

I am writing to request an internal review of Parliamentary and Health
Service Ombudsman's handling of my FOI request 'PHSO Organigram'.

As I cannot understand why the names and job designations of the PHSO 's
senior officers are secret, and this request no longer hinges  on  future
publication of an 'organigram' , with narrowing  of the request.  please
respond to the clarification.

Logically, the data must be held within HR.

It is reasonable for the public to know who is in control of the PHSO 's 
37m publically funded budget.

Dear Lant Mark,
Thank you for your response, but just to be absolutely clear, when I specified that since the organigram did not need to be provided -since that was the specific diagrammatic infuriation that is provided on the PHSO's internet site.

And clarified that it was just the names of senior officers found within the organigram, that I then requested, that the PHSO had NONE of the clarified requested data on file - naming the senior officers and posts concerned. ( including the HR deparrment files /or internal guidance) - as your response seems to state that that is the case.

Thank you for your further emails.

The PHSO holds the names of senior staff on their relevant HR files. She however makes the identities of her senior staff available through her website and is therefore entitled to refer members of public to that source which is regularly updated. As you know we have been in the process of updating that chart currently and for that reason we are satisfied that section 22 FOIA 2000 applies.

This concludes the PHSO’s handling of this matter. It remains open to you to contact the Information Commissioner’s Office should you remain dissatisfied about this issue.

The point is that there are more employees on the organigram than on the website.

HR must clearly have the data requested on file, even though it s not in the form of the organigram.

Data could therefore be produced, even though names are not slotted into that particular form.... as I have stated.

The only other conclusion is that the PHSO does not know who the PHSO's officers are, as there is no file data on them.

Which seemingly, due to your reply, isn't entirely out of the question.

And it is the PHSO that has stated that the organigram is produced quarterly - not me.

Could you kindly confirm that the PHSO gave wrongful information to the public on this point?

And, if it no longer produces the organigram quarterly as stated - what is the new schedule?

How on earth does it operate?
