PHSO decisions/lack of decisions over concerns raised

SAR/ FOI requests
A data application was originally made in June 2023 to the PHSO and it has repeatedly been re-submitted.
Please provide all personal and public data under all applicable legislation, including:
All internal PHSO communications from 2018 until present.
All communications to and from third parties since 2018.
Information relating to the processing of my data.
Information relating to any parties outside of the PHSO involved in decisions made by the PHSO.
Data provided should not emails sent to the PHSO by me.

(PHSO) Freedom of Information and Data Protection Team. This is to confirm
we have received your request. If you have made a request for information
under the Freedom of Information Act 2000 or Environment Information
Regulations 2004, we aim to respond to your request within 20 working days

Our response:
Section 8 of the Freedom of Information Act 2000 sets out the criteria for
what constitutes a valid request. Section 8(1)c requires that the request
for information must adequately describe the information sought.
Unfortunately, your request does not adequately describe the information
sought and is therefore not a valid request.
Please bear in mind the legislation allows access to information 'held' by
us and not for the creation of new information or opinion. Therefore, we
may only be able to supply documents or data that contain the information
we hold in response to your request.
The department reasonably requires further information to identify and
locate the information that you have asked for.
Please clarify detailing specifically what information is sought.
It may be that the information can be found on our website, there are a
wide range of policies and procedures on our publication scheme.

The Ombudsman draws his powers from two Acts of Parliament. The Health
Service Commissioner’s Act 1993 and the Parliamentary Commissioner Act
1967.

In relation to your request for details of “any parties outside of the
PHSO involved in decisions”. This information is not held we are an
independent Ombudsman hence our decisions are our own and final.

“Information relating to the processing of my data.”
This is a request for your own data and will be dealt with as a Subject
Access Request and not a request under the Freedom of Information Act, we
have already recorded a Subject Access Request and a request for Material
Evidence, which is described as the information we used to decide about a
case. We have acknowledged these requests and confirmed that we would
normally aim to respond to within a month.
All information you are entitled to under the legislation that governs
those types of requests will be disclosed to you. However, we are unable
to do this without a suitable email address to respond to. As explained in
our email 25 September 2023 it is not appropriate to request personal data
via the What do they know website.
Requests made under the different Acts are recorded and responded to
separately. This is because requests for personal data are private,
requests under the Freedom of Information Act are published on our
disclosure log.
If we do not receive a response to this request for clarification within 8
weeks, we will close the request – No Clarification received. This will
only apply to the Freedom of Information aspect of your requests. We await
a suitable email address for the Subject Access and Material Evidence
requests.
We hope that this information is useful.
If you believe we have made an error in the way we have processed your
information request, it is open to you to request an internal review. You
can do this by writing to us by post or by email to
