Hello,

Under the Freedom of Information Act, I would like to request the following;

1. Any documentation, guidance, instructions, notes, memos, emails, meeting minutes etc. Discussing and/or confirming the decision to prohibit parents and relatives from taking photographs during the Nativity Performance.

2. Any documentation, guidance, instructions, notes, memos, emails, meeting minutes etc. Discussing and/or confirming the decision to allow the Hartlepool Mail to attend a rehearsal and take photos for publication and commercial re-sale.

3. Any agreement, commercial or otherwise between the School and the Hartlepool Mail or any of their parent or subsiduary companies.

Dear Mrs Tickel,

I write in response to your request for information regarding the school nativity performance. Please accept my apologies for the delay in responding to your email, Unfortunately our school has had technical problems which has meant access to the network has been restricted.

In response to your questions I can advise as follows:

1. Any documentation, guidance, instructions, notes, memos, emails, meeting minutes etc. Discussing and/or confirming the decision to prohibit parents and relatives from taking photographs during the Nativity Performance.

Rossmere Primary school has had regard to the Information Commissioner's guidance to schools. A copy is attached, specifically section 13 which states:

A school may still have a policy restricting the taking of photographs or other images (for instance, for child protection reasons or to prevent disturbance).

Please see attached document which forms part of the 'Home -School Agreement.' Not all parents/carers consent to allowing their child to be photographed, therefore the school does not allow parents/carers to take photo's during the nativity performance.

This all forms part of our Safeguarding Policy and Vulnerable Pupil Procedures to ensure all of our pupils are kept safe in the school environment.

2. Any documentation, guidance, instructions, notes, memos, emails, meeting minutes etc. Discussing and/or confirming the decision to allow the Hartlepool Mail to attend a rehearsal and take photos for publication and commercial re-sale.

No documents are held.

The Hartlepool Mail contact the school to find out when the performance will take place. As a school we then follow protocol and go through the consent forms to see which children are able to be photographed where the parents have given consent.

3. Any agreement, commercial or otherwise between the School and The Hartlepool Mail or any of their parent or subsidiary companies. No such agreement is held.

I hope that this information deals with your request, however if you are dissatisfied with the handling of your request, you have the right to ask for an internal review. Internal review requests should be submitted within two months of the date of receipt of the response to your original request.

If you are not content with the outcome of the internal review, you have the right to apply directly to the Information Commissioner for a decision.
