Phorm: Confirmation of Police Inquiry

Dear Sir or Madam,

In September 2008, amid controversy, DS Barry Murray refused to investigate allegations of serious Criminal Offences by BT and Phorm (including illegally intercepting the private communications of thousands of BT customers, and the businesses who served them).

In October 2008, a request was then made to the Crown Prosecution Service, for permission to commence a private prosecution.

In recent correspondence from the CPS I have been told that DS Murray is once again investigating the same allegations.

Please could you;

- Confirm the crime reference number is 5253/08

- Confirm the name of the officer(s) leading the inquiry

- Confirm or deny that, since October 2008, City of London Police officers have been instructed to reinvestigate this matter

- Confirm that a case file has been passed to the Crown Prosecution Service Complex Casework Team at Ludgate Hill

- Disclose the date when that investigation was reopened

- Disclose the date when the resulting case file was passed to the CPS

- Disclose the name of the Police operation (if any)

Dear Sergeant Reed,

please consider this one final request for you to provide the information asked of you.

Your response is now 5 days overdue. You are breaking the law; "a public authority must comply with section 1(1) promptly and in any event not later than the twentieth working day following the date of receipt". That date passed on 20 November 2009.

Please provide the information required in my FoI request without any further delay, else a complaint to the Information Commissioner, and my Member of Parliament, will follow.

2. DS Murray is the Officer in Charge.
3. The City of London Police was asked to provide further evidence, by the
CPS in October 2009.
4. The case papers were passed to the CPS in December 2008.
5. On instruction of the CPS in October 2009.
6. No file has been submitted to the CPS following their `further
evidence' request, to date.
7. There is no operation name for this investigation.
