Phone calls from NHS trusts 2

Susan Wilkinson made this Freedom of Information request to Parliamentary and Health Service Ombudsman

This request has been closed to new correspondence from the public body. Contact us if you think it ought be re-opened.

Response to this request is long overdue. By law, under all circumstances, Parliamentary and Health Service Ombudsman should have responded by now (details). You can complain by requesting an internal review.

Dear Parliamentary and Health Service Ombudsman,

If the PHSO receives a phone call from an NHS nurse asking for advice on abusive patient behaviour would a record be mad of the phone call?

Yours faithfully,

Susan Wilkinson

Dear Ms Wilkinson

Thank you for your email dated 1^st February 2014 where you request the
following information:

If the PHSO receives a phone call from an NHS nurse asking for advice on
abusive patient behaviour would a record be mad [sic] of the phone call?

I am treating your correspondence as a request for information under the
Freedom of Information Act 2000 (FOIA).

We do endeavour to provide information whenever possible. However, under
section 14(2) of FOIA, a public authority is not required to comply with a
request for information if it is identical or substantially similar to a
request which it has already complied with, unless a reasonable amount of
time has elapsed between the two requests. This request is substantially
similar to your previous request which we complied with here:

[2]https://www.whatdotheyknow.com/request/p...

The Information Commissioner’s guidance on repeated requests is available
at:
[4]http://ico.org.uk/~/media/documents/libr...

The ICO guidance advises that in considering whether a reasonable period
of time has elapsed between the previous request and the new request,
there are two questions which will help the authority:

(i) has the information changed?

(ii) have the circumstances changed?

In this case, the information we hold is the same as at the time of your
previous request. We have also considered the circumstances and have
concluded that there has been no significant change. For these reasons, we
consider that your request is repeated and we are not obliged to comply
with it

If you are unhappy with my handling of your request you can ask for an
internal review by writing to the Review Team at:
complaints[5][email address]

If you remain dissatisfied it is open to you to approach the Information
Commissioner’s Office. Details of how to do so can be found on their
website at: [6]www.ico.org.uk

Yours sincerely,

FOI/DP Officer

So many requests from so many different people all asking the same thing. Wonder if PHSO ever sit round the table and ask themselves why?

[Name Removed] (Account suspended) left an annotation ()

Its obviously another consistent problem for complainants which needs to be swept under the carpet. (As was Mid-Staffs and Morecambe Bay).

The biggest problem with the PHSO is that it seems to believe the word of any government organisation over that of the complainant, even when the evidence is in favour of the complaint 90-10 - on record.

All the the government organisation seems to have to do is argue
' mis - filing' or make a telephone call off-the-record - and the PHSO is happy with that.

But that would be collusion and corruption - surely not.
