Dear Her Majesty’s Courts and the Tribunals Service,

If the Upper Tribunal, does not hold any Caseman, aka Computerised Court Records for a particular case, does that mean, that the case was never Issued By The Court, and is Void Ab Initio, being a violation of the County Court Act 1984 s.135, yes or no?

Yours faithfully,

Anthony Badaloo

HMCTS Customer Service (Correspondence),

Thank you for your enquiry.

Upper Tribunals do not have to comply with the County Court Act 1984. They are governed by Tribunal procedure rules.

HMCTS Customer Service (Correspondence),

Dear Mr Badaloo

Thank you for your further e-mail of 24 May.

"Does the Upper Tribunal have to maintain Computerised Records, yes or no?"

Each Chamber of the Upper Tribunal does keep electronic records. I do not know whether they are specifically required to keep records in electronic format by law, and you may wish to seek independent advice if you are concerned about any legal requirements for electronic record keeping.

If you are concerned about the keeping of electronic records at a specific Chamber of the Upper Tribunal, then you may wish to contact the Chamber to ask about this. You can find contact details, and more information for each of the four Chambers of the Upper Tribunal online at https://www.gov.uk/courts-tribunals/uppe..., https://www.gov.uk/courts-tribunals/uppe..., https://www.gov.uk/courts-tribunals/uppe... and https://www.gov.uk/courts-tribunals/uppe....

I hope this information is helpful.

Yours sincerely

Dear Her Majesty’s Courts and the Tribunals Service,

Please pass this on to the person who conducts Freedom of Information reviews.

I am writing to request an internal review of Her Majesty’s Courts and the Tribunals Service's handling of my FOI request 'Phantom Case Epidemic'.

I have been bullied by being told to seek independent legal advice, about a simple question, which the HMCTS must answer, in accordance to my rights, under Common Law, and the ECHR.

A full history of my FOI request and all correspondence is available on the Internet at this address: https://www.whatdotheyknow.com/request/p...

Yours faithfully,

You must answer the simple question, whether on not the Upper Tribunal, which you told me, is a SUPERIOR COURT OF RECORD, has to maintain electronic records of proceedings, and I require a simple answer, yes or no?

I also require to know, as a Superior Court of Record, whether the Upper Tribunal, is required to make and keep recordings of proceedings, yes or no?

I am writing to request an internal review of Her Majesty’s Courts and the Tribunals Service's handling of my FOI request 'Phantom Case Epidemic'.
