PFI schemes

To whom it may concern,

Please can I request under the Freedom of Information Act the following information in relation to the Private Finance Initiative contract(s) struck by yourselves (or your predecessor organisations):

1) For each contract, the projected total (whole life) cost of the scheme, in £, detailed when the scheme was first agreed (i.e. the original projected cost of all Unitary Charge Payments over the full life of the scheme).
2) The projected total (whole life) cost of the scheme, in £, as at August 1, 2019 (i.e. the real cost for previous years and projected cost for future years of all Unitary Charge Payments over the full life of the scheme).

If there is a difference between 1 and 2, please can you provide details of:
A) The date(s) the projected costs changed
B) The reason(s) the projected costs changed

Please can I also request:

3) A copy of the original contract/agreement;

4) An itemised list of any payments made to the PFI contractors for services not included in the original PFI deal, from the beginning of the deal to the current date, and to include exact details of what was being paid for.

If the following request cannot be met within cost limits, please can you provide me with guidance and assistance on how I may refine my request.

This covers general recorded information that is held by the Council.
Examples: budget information, staff structures, details of contracts etc

From the next working day that the request is received we have 20 working
days to respond. This does not take in to account any clarification we may
require or if we need to consider the Public Interest Test which allows us
up to a maximum of 20 additional working days.

Environmental Information Regulation
This covers all environmental information held by the Council.
Examples: Planning Applications, details of proposed road works, flood
information, pollution information etc.

From the next working day that the request is received we have 20 working
days to respond.

Section 7 of the Data Protection Act (Subject Access Request)
This section of the Data Protection legislation only relates to requests
for information about the requester or a client if you are acting on their
behalf.
Examples: Personnel file, Housing file, Council Tax/Housing Benefit
information etc.

We have 40 days from the date of receipt to respond.

2019, please find our response below.

We must inform you that, in accordance with Section 12 of the Freedom of
Information Act, we are unable to fully answer your enquiry without
exceeding the time/costs limits under the Act.  Where a local authority
reasonably estimates that it would cost more than £450 (or 18 hours of
staff time) to fulfil a request it is not required to do so.

 

It is estimated that your request will be above the £450 time/cost limit
because we do not hold this information in the format you have requested. 
In order to answer your request would require some manipulation and
calculations.

 

Whilst this is a strict interpretation of the Act, the Council policy is
to provide a balance between the needs of the requester and the use of
resources to ensure effective service provision is maintained.  We
therefore provide the attached spreadsheet relating to the Orchard Park
PFI scheme.
