1. Can you please tell me how many companies submitted an
application for the tender of this PFI?

2. Can you please supply copies of the actual applications each company made please?

3. The actual PFI went to: Consort Healthcare (Durham) Limited.
This is owned as follows:
Balfour Beatty 50%
Royal Bank of Scotland 50%

Was one contract signed between Sunderland Council and the company named: Consort Healthcare (Durham) Limited?

Or was 2 differing contracts drafted and signed with each company concerned above?

4. Can you supply me with the said contract/s asked in question 3 please?

limit for responses is suspended until receipt of the payment.

In line with the Information Commissioner's directive on the disclosure of
information under the Freedom of Information Act 2000 your request will
form part of our disclosure log. Therefore, a version of our response
which will protect your anonymity will be posted on Durham County Council
website.

Dear Neale Boswell,

Regarding this point:
"If the information you request contains reference to a third party then they may be consulted prior to a decision being taken on whether or not to release the information to you."

Please can you outline where in the Freedom of Information Act 2000 it stipulates that you "consult" a third party regarding a freedom of information request?
If you cannot show where within the Freedom of Information Act 2000 that gives you the authority to consult a third party prior to a decision, can you please state which law you are deriving the authority to do this from please?

I can understand being respectfully and having a good business etiquette to inform a third party upon any release of information. Unless you can show lawful process, I do not agree to a third party being part of your decision making process.

Our response: Durham County Council has had no involvement in this
process. The public authority responsible is North Durham Acute NHS Trust
sponsored by the Department of Health.
