PFI Advisers - Conflict of Interest

The request was refused by Croydon Borough Council.

Dear Croydon Borough Council,

Which companies have advised the LA on PFI projects and contracts from inception, through procurement, to financial close, during construction and operation on issues relating to structural, legal, financial, governance, audit and performance review. Please provide that information by each PFI scheme, providing the HMT unique reference number.

Please provide documentation demonstrating how the Local Authority selected the advisers referred to above? Please provide any internal or external process documents (for e.g from HM Treasury/ Partnerships UK) in relation to the selection, a copy of invitations to tender and tender documents.

Please provide documents demonstrating how the local authority, as part of that selection, ensured that LA auditors and lawyers, accountants and business consultants referred to above are not conflicted in any way with any of the organisations involved previously or currently with your PFI project(s). This could include documents, statements and correspondence between the local authority and its auditors relating to any conflict of interest or potential conflict of interest.

Please provide all policies/protocols or any other documentation which demonstrate how the LA ensure that auditors and consultants continue to be free of conflicts of interest.

Your request is being considered and you will receive a response within
the statutory timescale of 20 working days, subject to the application of
any exemptions. Where consideration is being given to exemptions the 20

authority. You will be informed if your request is transferred.

 

If we are unable to provide you with the information requested we will
notify you of this together with the reason(s) why and details of how you
may appeal (if appropriate).

 

Please note that the directorate team may contact you for further
information where we believe that the request is not significantly clear
for us to respond fully.
