Peter,

Ask for an internal review and then complain to ICO.

You have provided a the info required.

Dear The Police Federation of England and Wales,

Please pass this on to the person who conducts Freedom of Information reviews.

I am writing to request an internal review of The Police Federation of England and Wales's handling of my FOI request 'PFEW member suicides whilst under investigation'.

In submitted this FOI request to you organisation in 19/02/17 and on 17/03/17 i was informed that you were not subject to the FOI until 03/04/17. On 02/05/17 i raised this again with you to be answered but you referred me to you email asking me you review my request after the 03/04/17? Could you please review my original FOI request and answer it please. For the avoidance of doubt the request I would like you to respond to under the FOI is as follows;

"How many PFEW members have committed suicide whilst under investigation or facing sanction for either criminal or misconduct allegations and / or findings since 01/01/2007?

Please provide details of those cases you identify, namely;
Name
Rank
Date of suicide
Status / type of criminal and / or misconduct process

Yours faithfully,

PETER BARNET"

Information Governance Team, The Police Federation of England and Wales

Dear Mr Barnet,
I write to acknowledge receipt of your email dated 3rd May, 2017 requesting an internal review of the Federation’s approach to the handling of your request for information dated the 19th February, 2017.
I can confirm that the Police Federation is subject to the Freedom of Information Act and we shall respond to valid requests for information in accordance with our obligations under the act.
Your original request was not valid as it was made before the Police Federation became subject to the Freedom of Information Act. This was explained to you in a letter dated the 16th March, 2017, where you were also advised to submit a new request on or after the 3rd April.
This course of action was taken after consulting with the Information Commissioner’s Office, who advised the Federation that requesters have no information access rights and no rights to complain through ICO for any requests submitted before the 3rd April. For this reason, it is best to encourage requesters to initiate new requests on or after the 3rd April.
We have reviewed our approach following receipt of your email dated 3rd May and, while we believe our previous advice for you to submit a new request, which was not tagged to the original request, was clear, we are prepared to respond to your correspondence of 3rd May as a new request from that date and we can respond as follows.
We have conducted a search across our information assets in response to your request and I can now advise you that the Police Federation of England and Wales does not hold the information you seek and we cannot therefore provide it.
I am sorry we cannot provide further assistance in response to your request.
Best regards,
Information Governance Team
