Personal data on service users

My questions are as follows:-

1/ Where data is held by WSCC on service users of social services, who has access to this data to view or alter that data, that is employed by the WSCC.

2/ Does any one person employed within WSCC have access to private medical records or any other records held by any authority that is covered under the services provided by the payment of council tax in the WSCC area or is there a restriction on who can access this personal information.

3/ Where data is shared concerning a service user, amongst all service providers i.e. social services, police, health authority, local council etc. which level of staff can have access to these records, please give the levels of staff that can and please could you supply the code of conduct that applies to the sharing of service users personal information.

I am writing in response to your Freedom of Information request of 25
August 2013, regarding personal data on service users.

 

1/ Where data is held by WSCC on service users of social services, who has
access to this data to view or alter that data, that is employed by the
WSCC.

 

The core data held on an individual (name/DOB/address) can be accessed by
anyone who has access to frameworki, (the electronic recording system used
in Children's and Adults Services.) Changing these details can be
undertaken by anyone with 'update access'. However, case recordings can
only be added to or changed by those who have access to the record for a
legitimate reason. Access is controlled by 'worker role'. When a document
or case note is 'finished' it cannot be amended by anyone apart from the
'Help Desk' following a request from a social worker, supported by a
manager. A record of 'records amended' is kept. 

 

2/ Does any one person employed within WSCC have access to private medical
records or any other records held by any authority that is covered under
the services provided by the payment of council tax in the WSCC area or is
there a restriction on who can access this personal information.

 

Medical information would be requested for the purposes of completing
assessments or investigations, and provided by the relevant medical
practitioner. It cannot be directly accessed by WSCC employees. Signed
consent would have been received from the subject in most cases where
information is shared, unless it relates to a Safeguarding matter, in
which case all professionals have a duty to share relevant information.

 

3/ Where data is shared concerning a service user, amongst all service
providers  i.e. social services, police, health authority, local council
etc. which level of staff can have access to these records, please give
the levels of staff that can and please could you supply the code of
conduct that applies to the sharing of service users personal information.

 

Information is shared through reports and assessments which should always
have been also shared with the subject so that their views could be sought
and any inaccuracies corrected or a contrary view or dispute recorded.
Again, access to these records is determined by a workers role and so it
could be an administrator, Assistant Care Manager, social worker or
manager who has legitimate access to the record.
