2022, please find our response below.

 

 

In accordance with Section 17 of the Freedom of Information Act, the
Council is required to inform you that some of the information you have
requested has not been provided and has been withheld due to the following
exemption under the Act.

 

It is considered that this exemption under Section 40(2) (b) of the Act
applies, namely that some of the information is personal information and
disclosure would breach the rights of the individuals under the Data
Protection Act. The Council cannot disclose personal information where to
do so would breach any of the data protection principles.  In this case we
are unable to provide the information for question 4 as the notes made by
the transport panel relate to individual children.

The options and process of applying for transport are published on the
Council’s website [1]here; this includes those parents of children with an
EHCP.

 

Transport for all children, including those with an EHCP, are decided by a
multi-agency panel to ensure a co-ordinated and informed response.

The Panel refer to the Council’s published policy for home to school
transport which sets out the legislation and guidance for SEND Parents.
Please find a copy attached.

I am writing to request an internal review of Hull City Council's handling of my FOI request 'Personal Budget for Transport for EHCP children to Appoint Own Taxi Service Provider'.

I appreciate your reply.

It does not respond to the specific request to obtain internal data of direct budgets for transparent. Ie not mileage but process, legislation to obtain the SEND child transport budget and for the parents to contract the driver themselves. You have provided the public facing guidance and this is not what was requested. Please can you review and provide the internal standard operating staff procedures for review. assessment of personal transport budgets in the above context and not mileage rates for SEND children transport.

How many SEND parents in Hull hold a transport budget not a mileage rate) to appoint their own driver/taxi contract for their child?

Also, you appear to misunderstand that we require personal transport outcomes, we do not. We have requested copies of the internal standard operating procedures applied by the panel review to review/assess/reward and or cancel SEND child transport. The legislation for each out come applied i.e. simply stating that post 16 years SEND children with an EHCP cannot receive transport to a school as the legislation states that it is not necessary as not compulsory school age would be a blanket refusal to service users hence what internal thresholds are applied to ensure the best outcome for the service user.

We appreciate the general public guidance but we requested the internal standard operating procedures , thresholds reviewed by the transport team and the panel .
