Dear East Devon District Council,
Application no 22/2802/AGR could the council provide me where land held with land in a forestry application has to be whin a certain distance and where it states this so I can look it my salf as in my planning application the council ruled that the land held with my land was some distance from the site and is considered to go beyond the scope of the permitted development right. so where did this information come form

Dear Mr Lacey,
Thank you for your email. I am sorry that you haven’t received a response
to your FOI enquiry regarding your query as to where it is documented in
our policy and procedure that the distance between land held by a
developer has to be a certain distance for the permitted development. This
was overlooked accidentally.
I can confirm that nowhere does it state that land held by a developer has
to be a certain distance apart for permitted development.
Part 6 of the General Permitted Development Order states that development
shall only be permitted where the works are carried out on land used for
the purposes of forestry, including afforestation, of development
reasonably necessary for those purposes.
The issue of the distance between the site and land elsewhere used for
forestry purposes was addressed by the inspector in assessing
APP/U1105/W/23/3325082. At paragraph 16 the inspector states;
‘I note the evidence demonstrating that the appellant has an external
contract to clear weather damaged and Ash Dieback infected trees, along
with ongoing maintenance at a 10ha woodland site in Chard. However, there
is no substantive information regarding the amount of work this would
actually entail, for example through a management plan or survey
information. Nor do I find that the provision of forestry services at a
location some distance away demonstrates that a forestry building would be
reasonably necessary at the appeal site.’
