Permitted Development
Dear East Devon District Council, could you please provide me where by law it states in the nppf and the ppg /GPDO that a planning officer can refuse a permitted development application on grounds he/she own opinion on what time scales on how many trees can be planted a year and how big the afforestation project is. as the uk gov have Cleary stated that any thing over 0.5 hectare is classed as afforestation. and how much forestry needs to be carried out on that land as class E only states the carrying out on land used for the purposes of forestry, including afforestation, of development reasonably necessary for those purposes and dose not give any other restrictions attach to it. so by law how can a planning officer refused a building if both operations are being carried by law

This part of your request does not fall within the parameters of Freedom
of Information legislation. You are asking an open ended question which we
do not have to answer under FOI.
As the uk gov have Cleary stated that any thing over 0.5 hectare is
classed as afforestation and how much forestry needs to be carried out on
that land as class E only states the carrying out on land used for the
purposes of forestry, including afforestation, of development reasonably
necessary for those purposes and dose not give any other restrictions
attach to it.
So by law how can a planning officer refused a building if both operations
are being carried by law - This part of your request does not fall within
the parameters of Freedom of Information legislation. You are asking an
open ended question which we do not have to answer under FOI.
