Permission from Talbot Green Retail Park for enforcement agents to enter

The reason I ask is that enforcement agents DO NOT have the power to carry out their line of work unless permission has been requested.

Also the retail park carry out their own litter cleaning and has nothing to do with the council

Now we are at 15 days from the date of your FOI request which wasn't exactly a complicated question. And it was obvious you were referring to Litter enforcement. Maybe you should submit a separate and more detailed request asking about Parking enforcement in Talbot Green for the last 3 years.

I do believe that your recent reply is nothing more than a time wasting tactic.

Rather than asking me if the enforcement agents job in question related to parking or litter. You could have answered both.

Please note , that I have already know the answer, obtained from savills, the management company for Talbot Green Retail Park, and therefore I am confirming this information with you. Please respond in a timely manner.

Also under the Service Contract Agreement they have with 3GS, The dates, locations and nature of any offence is supposed to be supplied to RCT Council on a monthly basis. This information they refuse to release to the public.

Dear Mr Kiernan,

 

We sincerely apologise for the delay in response to your Freedom of
Information Request in respect of if permission has been requested and
granted by the Authority from Talbot Green Retail Park, for allowing
enforcement agents on to the private land to carry out their line of work.

 

The Authority’s response is as follows:

 

Section 87 of the Environmental Protection Act, which creates the offence
of ‘littering’ applies to the Talbot Green Retail Park on the basis that
s18 Clean Neighbourhoods & Environment Act 2005 widened the application of
s.87 to cover ‘private land’. 

 

Guidance states that authorised officers of the Council are required to
gain the permission of the landowner before they can enter ‘private land’,
unless it is land to which the public are entitled to have access i.e
where they already have implied permission to enter (such as Talbot Green
Retail Park).

Section 87(4A) Environmental Protection Act 1990 states that no offence is
committed under s87(1) where the depositing of the litter is—

(a)authorised by law; or

(b)done by or with the consent of the owner, occupier or other person
having control of the place where it is deposited.

 

Discussions took place in 2014 with the management company responsible for
the retail park who supported the Council’s offer to patrol the area.

Discussions took place in 2014 with the management company responsible for
the retail park who supported the Council’s OFFER to patrol the area.

So they claim they do not need permission to enter yet they say their offer was accepted?
I wonder if the retailers are aware that their landlord has given permission for a private company to stalk their customers.
