Dear Ministry of Justice,

I make this request under the Freedom of Information Act 2000. I refer to the perjury and fraud acts in relation to HM Adjudicator to the Land Registry. I also refer to the fact that statutory declarations made out to the adjudicator are solemn pronouncements in law and lying in them is illegal.

Can you please provide to me an overview of the policy and actions of the HM Adjudicator to the Land Registry in the following scenarios?

1/ What does HM Adjudicator to the Land Registry do if it becomes aware of an applicant for a restriction on a property committing an alleged offence under Section 5 of the Perjury Act which forbids any person from making a false statutory declaration.
2/ Does HM Adjudicator to the Land Registry investigate these matters as outlined at 1/ or does the Adjudicator refer such alleged offences to the police?
3/ What is the policy of HM Adjudicator to the Land Registry in the case of an applicant for a restriction wilfully misrepresenting the facts in a statutory declaration as presented formally to the Adjudicator for the Land Registry?
4/ Does HM Adjudicator to the Land Registry take any action in relation to a wilful attempt by an applicant to wilfully misrepreent the facts to or mislead the Adjudicator?
5/ Please provide an overview of the procedures or policy at HM Adjudicator to the Land Registry in relation to the perjury act or the fraud act when prima facie evidence is available that an applicant has wilfuly attempted to deceive the Adjudicator by misrepresentation contrary to these two acts?

Thank you for your e-mail below, I am writing to advise that we are not taking your enquiry forward as a Freedom of Information request.

It may be helpful if I explain that the Freedom of Information Act (2000) gives individuals and organisations the right of access to all types of recorded information held, at the time the request is received, by public authorities such as the Ministry of Justice (MoJ). Section 84 of the Act states that in order for a request for information to be handled as a Freedom of Information (FOI) request, it must be for recorded information. For example, a Freedom of Information request would be for a copy of a policy, rather than an explanation as to why we have that policy in place. On occasion, we receive requests that do not ask for a copy of recorded information, but ask more general questions about, for example, a policy, opinion or a decision.

Since you are asking for clarification on process in relation to the HM Adjudicator to the Land Registry, I have passed this to our Ministerial Correspondence Unit (MCU) who will process your query as Official Correspondence and you can expect a response directly from them.

Dear Data Access & Compliance Unit,

Are you stating that HM Adjudicator to the Land Registry has no written policies or procedures in relation to both the Fraud Act and the Perjury Act. If that is the case it appears to be an omission because I asked for such policies under FOI. I accept that the request was not written paricularly clear and may require an element of clarification. This eventuality is covered under the Act.

However no clarification has been sought and the "advice and assistance" requirement under section 16 has been disregarded.

However if an assurance can be given that the response will be full and informative from the correspondence unit I am happy with the compromise.

Fraud is happening through the Land Registry alright. Police will not investigate and then there is a big cover up.

Dear Tony.
The land registry are indeed corrupt and criminal. I can prove beyond any shadow of doubt that a member of the public entered false information, forged signatures and suppressed information in a case before the adjudicator. Neither AHMLR nor Land registry will pursue this mainly because it will also prove that land registry Plymouth also suppressed information, conspired to defraud, conspired to pervert the course of justice and took bribes in so doing. Chris - What happened when you presented your evidence to the Police, or brought your own Private Prosecution against either HMLR, the Adjudicator, or the person(s) you said you could prove of having committed forgery?

I'm genuinely interested to know what happened in your case.

The police solicitors agreed a crime had taken place but alas they say they will not investigate the matter as "we would stand to gain financially from any prosecution and that is not in the public interest". We are currently liaising with our solicitors to work out the best way to progress this matter. We can prove, beyond doubt, suppression of information by both a member of the public and [named individual removed] of land registry Plymouth.
