For avoidance of any doubt, can you also provide percentage of total student on roll whose "mother tongue" is reported to be English on the school register for this academic year.

You asked “can you please provide following information.

I would advise you that the Council holds this information, but considers
this is exempt under Section 21 of the Freedom of Information Act, as the
information is reasonably accessible to you by other means, because it is
already in the public domain. If you click on the following link this will

Section 21 of the Act provides that:

 

(1) Information which is reasonably accessible to the applicant otherwise
than under section 1 is exempt information.

(2) For the purposes of subsection (1)—

(a) information may be reasonably accessible to the applicant even though
it is accessible only on payment, and

(b) information is to be taken to be reasonably accessible to the
applicant if it is information which the public authority or any other
person is obliged by or under any enactment to communicate (otherwise than
by making the information available for inspection) to members of the
public on request, whether free of charge or on payment.

(3) For the purposes of subsection (1), information which is held by a
public authority and does not fall within subsection (2)(b) is not to be
regarded as reasonably accessible to the applicant merely because the
information is available from the public authority itself on request,
unless the information is made available in accordance with the
authority’s publication scheme and any payment required is specified in,
or determined in accordance with, the scheme.

Dear Freedom Info,

I am frustrated with your lack of co-operation in responding to what is a reasonable request.

This information is NOT available publically and if it was, I won't have raised a FOI.

I appreciate that you may be receiving a few request, however, kindly provide the information or another logical reason for not doing so. Simply saying that it is available publically is not possible because you won't publish number of children entitled to additional funding and total number of children on roll (for that funding) on a website.

I am sorry you are not happy with our original response to your request.

I confirm that the information is available in the public domain via the web link that we provided in our original response; the third line from the bottom of the tables under the heading School Details states: Percentage of pupils with English not as first language - 90.3%

Public authorities are entitled to engage the exemption set out at Section 21 of the Act where the information requested is reasonably accessible to the applicant by other means; in this case it is publicly available on the internet and we provided you with the link to that information.

If you still wish to pursue an internal review of our response to your request please let me know by return email. I will not take any further action in respect of this matter unless I hear from you otherwise.
