Dear Croydon Borough Council,
Please provide me with the finished report into financial mismanagement at Croydon Council, otherwise known as the 'Penn Report'. I note you published the Terms of Reference some 18 months ago, so it is fair to assume that the report has been completed and should now be in the public domain.

Thank you for your e-mail dated 5 July 2022 requesting ' the finished
report into financial mismanagement at Croydon Council, otherwise known as
the 'Penn Report' .
Your information request is being dealt with under the Freedom of
Information Act 2000 (the Act). We do hold the information you have
requested, however we need more time to consider your request.
We wish to advise you that the following exemptions under the Act apply to
some or all of the information you have requested: section 22 (information
intended for future publication); section 31 (law enforcement); section 36
(prejudice to effective conduct of public affairs) and section 40(2)
(personal information). The first three of these are qualified exemptions
meaning that your request can only be refused if, in all the
circumstances, the public interest in maintaining the exemption outweighs
the public interest in disclosing the information.
By virtue of section 10(3) of the Act, where public authorities have to
consider the balance of the public interest in relation to a request, they
do not have to comply with the request until such time as is reasonable in
the circumstances.
We have not yet reached a decision on the balance of the public interest
in respect of the exemptions under sections 22, 31 and 36 of the Act. In
the case of your request, we need to extend the time limit by
approximately 20 working days because we need more time to assess, in all
the circumstances, the public interest factors for and against disclosure
before deciding where the balance of public interest lies.
We hope to let you have a response no later than 30 August 2022. If you do
not receive our response or further update by then, please contact us at

If you are dissatisfied with the handling of your request, you have the
right to ask for an internal review. Internal review requests should be
submitted within two months of the date of receipt of the response to your

I am writing to apologise for the delay in responding to your request for

Unfortunately, due to operational pressures caused by the Covid-19
pandemic, we are finding that responses are being delayed beyond the 20
working day timescale. The Information Commissioner has recently published
guidance accepting that local authorities will have to prioritise other
