Penalty Charge Notices (PCNs) at the 'Dollis Hill Avenue' junction with 'Edgware Road' (using camera LW2522).
Dear Brent Borough Council,
Under the Freedom of Information Act 2000, I would like to request the following information relating to the issuing of Penalty Charge Notices (PCNs) at the 'Dollis Hill Avenue' junction with 'Edgware Road' (using camera LW2522).
I am only interested in PCN's raised under Code 53 (Failing to comply with a restriction on vehicles entering a pedestrian zone) at this location that fall within the period from Mon 11th March 2024 to the date of processing this enquiry. May I please obtain the following:
1. The total number of PCNs issued in relation to the above location involving a Code 53 restriction during the period specified?
2. How many of those PCNs have been challenged, and can I please have a breakdown of all the resons presented appealing them (such as incorrect, or non-existent, signage)?
3. Camera LW2522 is not listed as being under Brent Council’s control according to the webpage https://legacy.brent.gov.uk/gis-maps/cct... It is situated on the Barnet Borough Council side of the Edgware Road boundary. Please supply all documentation that is in place relating to the management and maintenance of this CCTV facility from the stakeholders involved.
4. When was the cautionary road signage warning of the restriction on the north-going approach (travelling from Cricklewood Bus Garage) to the above junction removed from its mounting post and placed on the pavement rendering it unreadable to motorists approaching the junction? Confirmation of when it was removed may be established from Brent Council's own Works Department records, Brent Council's online 'Report It' web portal, review of Brent Council's own CCTV footage or any other means at your office’s disposal.
5. For the record, the sign still remains on the ground at the time of writing this FOI request on 16th May 2024. Has an initiative to remount the signage been made by any Brent Council division since 11th March 2024?

I can confirm that Brent Council holds the information you have
requested.
1. The total number of PCNs issued in relation to the above location
involving a Code 53 restriction during the date period specified is: 355
2. Total number PCNs have been challenged, and can I please have a
breakdown of all the reasons presented appealing them.
Total number of representations is 23 made under the Statutory process. A
representation allows a motorist the opportunity to present grounds on
which to provide information as to why the PCN was incorrectly or unfairly
issued. Each representation is a personal and individuals’ reasons. A
summary of some of the reasons given by motorists is: that they were new
residents who had moved into Dollis Hill Avenue and failed to register
their vehicle for an exemption; were providing care to a resident living
on the road; were delivering goods; failed to notice the restrictions,
sighting inadequate warning or signage.
3. Camera LW2522 is a Brent installed and maintained enforcement camera.
Please see attached PDF of all Enforcement CCTV locations in Brent. Line
64 includes this camera. Local Authorities have boundary agreements in
place which are agreed between the respective Highways Management services
for the maintenance and responsibility of street furniture, lamp columns,
apparatus to name a few which are situated on the boundary line. This
section of road where the CCTV camera is installed is maintained by Brent
Council.
4. When was the cautionary road signage warning of the restriction on the
north-going approach (travelling from Cricklewood Bus Garage) to the above
junction removed from its mounting post and placed on the pavement
rendering it unreadable to motorists approaching the junction?
Brent Council have not removed the sign. Having checked our records, we
received a report that the Advance Warning Sign had fallen down in
November 2023 which was subsequently re mounted.
Following your FOI request, point 5 that you raised as below, we checked
our records again and found no reports were made from other members of the
public that the sign had again fallen. We were therefore notified by you
that the sign had fallen and arranged a site visit on 28/05/2024. The site
visit confirmed that the sign had fallen down but as this was not reported
earlier, we do not know how long it had been on the ground, and an order
was raised to our contractor to remount the sign.
Please note the advanced warning signs are not mandatory, whilst they
comply with Department For Transport guidance, we do not need to have
them, only signs on the entry points are required.
5. For the record, the sign still remains on the ground at the time of
writing this FOI request on 16th May 2024. Has an initiative to remount
the signage been made by any Brent Council division since 11th March 2024?
Thank you for informing the Council that the sign had again fallen. As
detailed on our response to your question 4, we undertook a site visit and
have raised an order for the sign to be remounted.

Thank you for your follow up email requesting additional information
following our response.
I note that you requested details relating to the inter-council management
agreement and maintenance records of this CCTV facility from the
stakeholders involved.
I would very much appreciate it if you could clarify what information you
are seeking.
The information provided in our earlier response advised that this is a
Brent CCTV installation. As such, the camera and accompanying signage has
been purchased and installed by Brent Council, the camera is also operated
and maintained by Brent Council on a section of the public highway that
Brent Council are responsible for.
As additional information, I can advise that Brent Council have a CCTV
contract with Tyco who provide maintenance across all CCTV installations
in Brent.
Please do let me know if there is any additional information that this, or
the earlier response has not addressed.

To further clarify my original request, I would be grateful for sight of the arrangement made between Brent and Barnet Councils establishing that this specific site is to be maintained by Brent? I believe you earlier referred to it as a "boundary agreement".
Secondly, can you supply all records relating to your contractor Tyco's maintenace duties for this site please?

I am writing to request an internal review of Brent Borough Council's handling of my FOI request 'Penalty Charge Notices (PCNs) at the 'Dollis Hill Avenue' junction with 'Edgware Road' (using camera LW2522).'.
Whilst a proportion of the information has been supplied, the remainder relating to (1) The boundary agreement and (2) Records pertaining to maintenance conducted at the site to date, has not materialised.
Clarification on these points was sought by Mr Vartanian on 21st June 2024. Despite two further communications from me in the interim there has been no further response. The WDTK website has flagged both as 'delivered'.
I am mindful that my next step is escalating this matter to the Information Commissioner but presume you would prefer that the matter be more satisfactorily resolved without recourse to an outside body.

Further to your request for an Internal Review of the handling of your
initial request for information where some of the information was not
provided, please accept my apologies for the delay in our response.
The information that was not provided to you in our response was in
relation to question 3 you had raised as below:

The CCTV enforcement infrastructure is maintained by our contractor Tyco
Security Products and Solutions. We are still awaiting details of the
maintenance records for camera LW2522 to be provided to us by Tyco and
apologise this is taking longer than anticipated. Once we have receipt of
the records, I will forward these.
With reference to your request for information in that you have stated
that camera LW2522 is not listed under Brent Council control and is
situated on the Barnet Council side, I can advise that the lamp column,
where camera LW2522 is installed, is a Brent Council asset. A new lamp
column to host the new camera was added to the location by Brent Council,
which as you have correctly indicated is on Barnet’s side but these are
maintained by Brent Council. I have requested our mapping team to include
this, our inventory, on the website once it was been plotted. As this is a
Brent Council asset, there are no documents or agreements with Barnet
Council in relation to the installation of the CCTV camera on Brent
maintained assets.
As soon as we have receipt of the maintenance records, I will provide a
full Internal Review response and thank you for your patience.
