Thank you for your request dated 1 September 2019 requesting information
under the Freedom of Information (Scotland) Act 2002 (FOISA).

 

You asked for  “All mainland and marine licence applications submitted by
Peel Ports to Marine Scotland - Licensing Operations Team, for all
projects, from the time Peel Ports took possession of the Hunterston
site.”

As the information you have requested is ‘environmental information’ for
the purposes of the Environmental Information (Scotland) Regulations 2004
(EIRs), we are required to deal with your request under those
Regulations.  We are applying the exemption at section 39(2) of the
Freedom of Information (Scotland) Act 2002 (FOISA), so that we do not also
have to deal with your request under FOISA. 

This exemption is subject to the ‘public interest test’.  Therefore,
taking account of all the circumstances of this case, we have considered
if the public interest in disclosing the information outweighs the public
interest in applying the exemption.  We have found that, on balance, the
public interest lies in favour of upholding the exemption, because there
is no public interest in dealing with the same request under two different
regimes.  This is essentially a technical point and has no material effect
on the outcome of your request.

We received your request on 1 September 2019 and will respond in
accordance with the EIRs by 30 September 2019, 20 working days from date
of receipt.

In order to identify and locate the information that you have asked for we
need some further information from you. From my investigations Peel Ports
acquired Hunterston in 2003.  In particular, it would be helpful to know
if you are requesting applications for all projects for all the ports that
Peel Ports own in Scotland since 2003 or whether you are requesting all
applications submitted by Peel Ports since 2003 for the Hunterston site.

submitted to Marine Scotland.”
