Dear Doncaster Borough Council,

Without prejudice to the generality of the foregoing, in particular the following questions under the Freedom of Information Act 2000.

I would like headline numbers for the lease

1. How much are the monthly lease payments?
2. What are the break clauses associated with the lease Peel? Do these align with the 5 year and 10 year milestones associated with the business case?
3. What advice has been taken on State Subsidy and Market Economic Investor Principle and how does the business case satisfy this?
4. What is the liability incurred by Doncaster Council and how long are we expected to pay for the the lease before payments are taken over by an operator? Can you also outline what the South Yorkshire taxpayer is now liable for and did we receive a rent free period?
5. Can you publish all the key milestones with this lease to demonstrate that Peel will not benefit other than the lease itself, ie subsidies for nearby developments

Response to questions 1, 2, 4 & 5:
This information is exempt from disclosure under Section 43 of the Freedom of information Act. Section 43 exempts information from the right of access under the Freedom of Information Act if disclosure of the information would prejudice someone’s commercial interests.

The information withheld under the exemption relates to ongoing negotiations regarding the lease for Doncaster Sheffield Airport, which is currently subject to a competitive procurement process. City of Doncaster Council believes that the release of this information would be likely to cause commercial prejudice to the organisations involved.

As Section 43 is a qualified exemption, City of Doncaster Council is obliged to consider whether disclosure of the information would be in the public interest before refusing to supply the information. Therefore, we have taken the following factors into account:

Taking these factors into consideration, City of Doncaster Council has decided that the reasons for withholding the information outweigh those for disclosing it and we will not be providing the information at this time.

Response to question 3:
This information is not held. Given that this is still a live procurement exercise, City of Doncaster Council are awaiting the submission of the final business case therefore, at this stage, we do not know if subsidy will be required. The Council will be taking professional advice in order to protect its position at the appropriate time.
