ACCOUNT, Unmonitored, Department for Education

Dear Michael John,

Thank you for your email which was received on 05/02/2021

You asked the following.

“Under the freedom of information act i require the information Held by
department of education in relation to School Children being tested for a
Corona Virus, Specifically if No Consent is Given for the Child to be
tested Via the unreliable PCR Test Then will the Child be Denied Entry to
the School and Fines issued by the Council to the Parents for Non
Attendance.”

We have dealt with your request under the Freedom of Information Act
2000. Information relating to your request is set out below.

Those who test positive using an LFD test through an Asymptomatic Test
Site do not need a confirmatory PCR test. Individuals with a positive LFD
result will need to self-isolate immediately in line with the
[1]stay-at-home guidance.
Confirmatory PCR testing remains in place for individuals who test at
home, to minimise the risk that incorrectly reported positive results are
registered. After receiving their positive LFD, the individual should
inform their educational setting of their result so the setting can
identify close contacts and they can make appropriate cover arrangements.
They should immediately self-isolate in line with the [2]stay-at-home
guidance until they receive their confirmatory PCR test.
All testing is voluntary. Staff, pupils and students are strongly
encouraged to participate as testing regularly helps to reduce the spread
in school and college settings through asymptomatic transmission.

Participation in the programme requires active consent from the person
being tested, or, if they are under 16, their parent or legal guardian.
Any staff member, student, or pupil who does not take part in testing will
still be able to attend school or college unless they develop symptoms or
have been in close contact with a positive result.

Education settings are the individual data controllers responsible for
processing any personal data, including obtaining and maintaining records
of consent, for testing carried out on their sites. As part of testing,
education settings share data on tests carried out with DHSC, at which
point DHSC becomes the data controller. Therefore, the Department for
Education does not hold further detail on consent obtained in schools.
