PCNs on TfL roads in Tower Hamlets

We're waiting for James Edwards to read a recent response and update the status.

Dear Tower Hamlets Borough Council,

Tower Hamlets Council enforces the banned left turn from Wentworth Street on to Commercial Road but the road markings at the junction show that it's a red route. Please supply me with the following information.

1) What other red route locations does Tower Hamlets Council enforce?

2) Please supply the information in a) to g) below per red route location that the council enforces and per year for the last five full financial years (2015-16, 2016-17, 2017-18, 2018-19 & 2019-20).

a) The number of PCNs issued.
b) The number of PCNs paid but not challenged at any stage.
c) The number of PCNs challenged at any stage.
d) The number of PCNs paid after being challenged at any stage.
e) The number of PCNs cancelled.
f) The number of PCNs written off.
g) The number of cases still open.

3) Please supply a copy of your agreement with Tranport for London allowing you to enforce those locations.

I am writing to request an internal review of Tower Hamlets Borough Council's handling of my FOI request 'PCNs on TfL roads in Tower Hamlets'.

You have tried to refer me to Transport for London however I know that Tower Hamlets Council has issued PCNs for contravention code 50L at "Wentworth Street (Commercial to Osborn), E1". As can be seen on Google Streetview (https://bit.ly/2Zxfwbn), the lines at the side of the road on this junction are red, not yellow, meaning that it is a red route.

I therefore repeat my request.

Dear Mr Edwards,

Unfortunately we have no record of receiveing the FOI request on the 18th June.

We then received a request on the 30th June which was rejected as we believed these were roads managed by TFL and not Tower Hamlets council.

We then receieved an email from yourself confirming TFL do not manage these roads and they are managed by Tower Hamlets. We have now passed this onto our parking department for them to process.

I have now raised this request under reference 23320741 . You should receive a response by the 7th August.

I am writing to request an internal review of Tower Hamlets Borough Council's handling of my FOI request 'PCNs on TfL roads in Tower Hamlets' on the following two points:

1) No TMO was attached to the response.

2) Although Tower Hamlets may have written the TMO, you do not have the power to enforce it. From the Tower Hamlets GLA Side Roads Order 2000:
"2.—(1) The roads in the London borough of Tower Hamlets specified in the Schedule to this Order are hereby designated as GLA side roads."
and
"SCHEDULE
154. Wentworth Street—
(b)(east arm) from the eastern kerb line of Commercial Street (A1202) eastwards for a distance of 8m."

And from the London Local Authorities Act 2003:
"4 (1) This section applies where-
(a) in relation to a GLA road or GLA side road, Transport for London or, subject to subsection (3) below, the relevant borough council...
have reason to believe [...] that a penalty charge is payable under this section with respect to a motor vehicle."
and
"(3) The relevant borough council shall not exercise the power exercisable by virtue of subsection (1)(a) above unless they have obtained the consent in writing of Transport for London."

The Side Roads Order says the actual junction of Wentworth Street and Commercial Street is a GLA side road and the London Local Authorities Act says that you cannot enforce it without written consent from Transport for London. You say that you have no agreement with TfL to enforce their roads, so q3 of my request has been answered, however it is now even more important that questions 1 and 2 are answered, as this enforcement is unlawful.
