Subject: PCNs issued in Bradfield Road, Silvertown
We write with regard to your recent enquiry for information held by the Council under
the provisions of the Freedom of Information Act 2000.
Request
1. Could you please provide following information for PCNs that were issued by
CEOs in Bradfield Road from 01 October 2022 to the date of processing request
preferably in the excel format:
Date of service of notice
PCN number
Vehicle number
Contravention Code
Location
Observation start time
Time of contravention
Date of contravention
Civil Enforcement Officer No
Has the vehicle been removed
Time of removal if applicable
2. How many PCNs were issued to VRN at the time of removal if this information
available
3. Reason for removal if applicable
4. Current status of PCN - For example: Paid reduced fine within 14 days, Paid
reduced fine after informal representation rejected, awaiting adjudicators decision etc
Response
1. Please see attached spreadsheet. The data range is from 01/10/2022 to
13/10/2023.
We are of the opinion that the disclosure of the PCN number and Vehicle
Registration Number under the FOI Act is personal information. We are not
required, under section 40(2) of the FOI Act, to provide information that is
personal to individuals as this is likely to contravene the data protection
principles. This is because the UK GDPR requires that the processing of
personal data must be fair and lawful by the London Borough of Newham.
2. The requested information is readily available. To obtain this information, each
vehicle would need to be checked individually for PCNs issued before the
removal. Under the Freedom of Information Act the Council can refuse a
request for information held if the cost of complying with a request exceeds
the appropriate limit. The appropriate limit for local authorities is 2.5 days or 18
hours. We believe in this case such an exemption applies and are unable to
satisfy your request for information under section 12(1) of the Act.
3. Please refer the second Tab of the attached spreadsheet under ‘Removals’
data - see ‘contravention code’.
4. Please refer to the ‘current stage’ on the attached spreadsheet.

If you are dissatisfied with the handling of your request, you have the right to ask for
an internal review. Internal review requests should be submitted within two months of
the date of receipt of the response to your original letter and should be submitted to
