Dear Lambeth Borough Council,

The following information is requested under the Freedom of Information Act.

A) For the calendar years 2008, 2009, 2010 & 2011

1. How many PCNs have been issued for code 34J contraventions for this bus lane?

2. What revenue has been generated by the CCTV camera(s) enforcing this bus lane?

3. Of those PCNs issued, how many have been cancelled (1) on appeal to Lambeth Council and (2) on appeal to PATAS.

B) In late 2009, Lambeth Council responded to public outrage by acknowledging that the bus lane was non-compliant and therefore unenforceable. In January 2010, works were undertaken to remedy this. Please advise what works were carried out then and what works have been carried out since.

C) I received a PCN following contravention of this bus lane on 19th April 2012 at 20:14hrs. In relation to this, please advise as follows:

1. I can find no published reference to Camera Lw0011. Please advise what camera this is and provide evidence that it is an approved device.

2. The PCN refers to "Observed by Camera Operator: LHUNATTENDED". Please clarify what this means, which operator issued the PCN and when it was issued.

3. Please provide a copy of the CCTV log for the period in question.

D) Please provide a copy of the applicable Traffic Management Order.

I got caught here too. I have written the following to Lambeth:

I am writing to ask you to withdraw this penalty, as I feel that the bus lane and left turn lane are confusing and easily misunderstood, especially for someone unfamiliar with the junction as I am. I did not see the left turn marking on the middle lane, because there were cars in front of me obscuring it. I assumed that like most junctions of this nature, with bus lanes in the run up to them, that the bus lane finished before the junction and that the middle lane was for traffic going straight on – I couldn’t see that there wasn’t a road going straight on.

I am aware that this junction has been the cause of considerable adverse publicity due to the extremely high number of drivers who make the same mistake as I did. I do not feel that the changes made in 2010 were effective in significantly reducing the number of drivers making this mistake to a level comparable with other similar junctions in London. As such, if you choose not to withdraw the penalty and the information that you disclose to J Astbury under FOI Request reference 159087 supports my belief, I will appeal to PATAS and bring it to the attention of interested media, the Mayor of London and the Minister of Transport, on the grounds that according to the Guidance To Local Authorities and reported statements from the relevant politicians, raising revenue should not be an objective of traffic management. To support this appeal, I will seek information under the FOI Act to ask you to produce statistics showing that the presence of the bus lane has significantly reduced wait times for buses at this junction and at what times of day wait times were significantly reduced.

I hope that you do in fact sympathise with my confusion on the approach to this junction and, on this occasion, do decide to withdraw the penalty, as this would be a concrete way of demonstrating that raising revenue is not in fact your objective.
