PCN Code Falsehood by Pembroke Council

Waiting for an internal review by Pembrokeshire County Council of their handling of this request.

Dear Pembrokeshire Council, Legal Services Department
I refer to my previous FOI : Ref 10815
Your reply has been received, it is however a falsehood.
You state that if a motorhome / campervan / motor car stays overnight and the person or persons are deemed to have or have slept, then you will / may issue a PCN 95 for "camping"

There is no such thing as a PCN code for camping
In addition, there is no sign contained in the TSRGD that applies to “camping”.
Pembroke Council are using intimidation to prevent people staying overnight in their vehicles as the occupants fear a "monetary penalty" because of falling asleep.
Would Pembroke Council issue a PCN95 to a disabled driver that had fallen asleep, or a penalty for a wheelchair bound occupant that had fallen asleep ?
I suggest this is forwarded to your Head of Legal Services and Scrutiny Committee for their perusal, I also suggest it is incumbent on Pembroke council to re-imburse those persons who have paid the monetary penalty for their false PCN.

I acknowledge receipt of your email and our parking manager has provided
the following response;

 

Code 95 refers to  - Parked in a parking place for a purpose other than
that designated.

 

Within our off street parking order we do not permit Overnight camping /
sleeping - this would be deemed as - Parked in a parking place for a
purpose other than that designated.

 

All vehicles parked in an off street parking place - car park - must
adhere to the off street parking order - dependant on the nature of any
contravention a Penalty Charge Notice may be issued - each case will be
looked at on their own merit an appropriate PCN will be issued.
