Thank you for your email dated 10 December 2013 and your request for
information therein.

Your request for information relating to details for all payments received
under Article 40 planning agreements from 2008-09 to 2012-13 has been
treated as a request under the Freedom of Information Act 2000.  I confirm
your request has now been processed as a request under the terms of the
Act and, accordingly, please see the response in red below.

Down District Council does have a consultative role in the planning
process but does not have responsibility for planning matters.  I would
respectfully suggest you direct your enquiry to the Planning Service,
which has responsibility for planning in Northern Ireland.  Down District
Council sits within the Local Area Planning Office for Down and can be
contacted via the Planning Manager, Local Area Planning Office,
Rathkeltair House, Market Street, Downpatrick, Co. Down, BT30 6EA or via
email at [email address].  They can also be contacted on
0300 200 7830.
If you wish to discuss the above or require clarification on any matter,
please do not hesitate to contact me directly.

Should you be unhappy with our response in this matter you may request an
Internal Review of our response and you can contact me in that regard. In
the event you are unhappy with the outcome of any Internal Review
conducted by the Council you may apply to the Information Commissioner's
Office (ICO) for a review of our response. Please note that the ICO
generally expects Internal Reviews to be completed prior to reviewing the
