Reference; Payments to the RSPB by the police.

Do the police pay the Royal Society for the Protection of Birds for
their 'assistance' in any respects? For example investigating
potential infringements of the law. If the police do pay public
money to the RSPB could I please see they accounts for the last two
years that relate to payments to the RSPB?

Could I have a copy of the binding codes of conduct in relation to
how the police supervise the way the RSPB handle evidence that has
been seized by the police under the power of a search warrant?

Could I also see the codes of conduct that allows the person who
has had his property seized to check the evidence to support his
defence?

I only want the specific sections that relate to my requests for
information.

Further to your email dated 11 May 2009 in which you made a request for
access to certain information which may be held by Northumbria Police.

As you may be aware the purpose of the Act is to allow a general right of
access to information held by a Public Authority (including the Police),
subject to certain limitations and exemptions.

In our initial acknowledgement to the above request, dated 12 May 2009,
Northumbria Police advised you that your request was identical to an
enquiry submitted previously by another individual. We have now
considered your request and advise the following:

Having fully considered your request we note that it is actually word for
word identical to an enquiry which was also submitted from the same
website by Derek Canning (request [email address]) and
which has been published on the same website.

That enquiry was a continuation of previous enquiries made by the same
applicant and which was determined as being vexatious. The applicant was
advised that similar enquires would not be answered or acknowledged.

Therefore please note that as your enquiry is word for word identical and
is clearly made in concert with the previous enquiry described above and
which is the latest in a series of requests that have been considered to
be obsessive and manifestly unreasonable, this enquiry has been determined
to be vexatious and Northumbria Police will not answer this enquiry or
acknowledge further similar enquiries.

Section 14(1) of the Act provides that:

Section 1(1) does not oblige a public authority to comply with a request
for information if the request is vexatious.

If you are unhappy with our decision or do not consider that we have
handled your request properly you may complain directly to the Information
Commissioner’s Office and request that they investigate to ascertain
whether we have dealt with your request in accordance with the Act. I

Your request for review asked:

"I am writing to request an internal review of Northumbria Police's
handling of my FOI request 'Payments to the RSPB by the police.***

Our initial response to you stated that your request was identical to a
request received from Derek Canning via the same web-site
(www.whatdotheyknow.com). This request was declared as vexatious as part
of Mr Canning***s requests to Northumbria Police on this subject.

I have again reviewed the request from you and the request from Mr
Canning. I have confirmed that they are identical and both did come
through the same web-site. This clearly indicates that you are acting in
concert with Mr. Canning on this subject. Please note that it is the
request is that is classed as vexatious and not the sender. This request
forms part of a pattern of requests that taken together form evidence of a
pattern of obsessive requests. We would therefore classify this request
as vexatious no matter where or who it comes from.

Mr Canning also requested an internal review and a final response has been
sent to him separately.

This request is one among many requests on this subject and can be classed
as obsessive and manifestly unreasonable.

Please note a public authority is not obliged to comply with a request for
information if the request is vexatious. The Information Commissioner***s
own guidance on vexatious requests states ***there is a risk that some
individuals and some organisations may seek to abuse these new rights with
requests which are manifestly unreasonable. Such cases may well arise in
connection with a grievance or complaint which an individual is pursuing
against an authority. While giving maximum support to individuals
genuinely seeking to exercise the right to know, the Commissioner***s
general approach will be sympathetic towards authorities where a request,
which may be the latest in a series of requests, would impose a
significant burden and can otherwise be characterised as obsessive or
manifestly unreasonable.***

The Information Commissioner has also stated that using FOI to re-open
long running disputes, is clearly inappropriate and the examination of the
previous history of the applicant and their requests to public authorities
is also very relevant to making an individual vexatious.

This concludes my internal review into your request under the Freedom of
Information Act 2000. If you remain dissatisfied with the outcome of this
review then it remains open to you to refer this matter to the Information
