Payments to Senior Officers

Dear Wirral University Teaching Hospital NHS Foundation Trust,

Between August 2013 and the present date, I am interested in discovering:

1. How many directors of the Trust have received severance / redundancy / compensation payments following internal disputes / complaints / staffing issues.
2. With regard to 1. above, dates of payments.
3. With regard to 1. above, amount of payments.
4. With regard to 1. above, reason for payments.
5. With regard to 1. above, have the payments / circumstances been declared publicly?
6. Subject matter, e.g. Racial Discrimination; Bullying &
Harassment; Dignity at Work Complaint, concerns about staffing issues, etc.
7. Copies of reports; aide memoirs; emails; letters; memoranda; notes; meeting minutes; meeting notes (verbatim or non-verbatim), whether in written or electronic format, and connected to board meetings, investigations (internal or external), and / or the processing of any payments.
8. Outcome - e.g. whether employees involved are still employed by the Trust.
9. Disciplinary Action taken, if any.
10. Number of employees (whether director or not) involved in dispute / complaint.
11. Number of employees (whether director or not) in receipt of payment(s).
12. Number of employees (if any) moved internally within the structure to another department / area within the Trust structure and name of new department / section for each employee.
13. How many directors of the Trust have (or have not) signed compromise / settlement agreements and left their posts.
14. How many directors of the Trust were suspended from their posts whilst an internal (or external) investigation was carried out.
15. The particular outcome of these investigations.
16. A copy of the investigator's report in each case (redacted as required to protect personal information under the DPA)
17. How many employees signed full and final settlements or compromise / settlement agreements, whether a payment figure is quoted within the compromise / settlement agreement or not.
18. Whether the compromise / settlement contained any gagging clauses.
19. Whether the compromise / settlement agreement contained any confidentiality clauses.
20. The nature of the gagging / confidentiality clause(s) used.

Please provide details of ALL WUHT directors who have been in receipt of payments, whether they be hidden, or declared openly and scrutinised by the Trust board, in these or
similar circumstances.

I am not asking for names or details of job posts, as I'm aware such details could be used to identify employees and
thereby infringe upon their personal privacy. Please redact such potentially identifying information where necessary, in line with the Data Protection Act.

However, please do not overstep the mark by redacting e.g. the quantities in public money that may have been paid out to directors / employees, because such details are vital to satisfy the legitimate and compelling public interest.

The only lawful means of withholding information is through an exemption within the Act or a section 14 refusal.

Here's a link to a quote from the Information Commissioner's Office. The officer concerned, Greg Jones, makes a very clear and broad ranging statement about the means available to data controllers for withholding information:

The statement clearly shows that THIS data controller is clearly in the wrong to withhold information on the strength of my requests being deemed "not applicable".

I will therefore be very surprised if my internal review is unsuccessful or, failing that, the ICO don't find in my favour when I appeal to them.
