b) Should that decision already be in the public domain enough details for me to find it eg date and number of portfolio decision or name and date of meeting etc, under the duty to give advice.

Dear Andrew Goodfellow,

Can you please tell me how long you expect to take over this?

I fail to see why there should be a delay. It was reported in the local media that receipts had been made available to opposition councillors so they are presumably to hand. And considering the level of expenditure concerned I suspect that the authorising decisions would be in the public sphere already and your response to this would merely be providing advice.

I am writing to request an internal review of Nottingham City Council's handling of my FOI request 'Payments to Harold Tinworth and/or his Company'.

I have asked you for an estimate of how long your reply is likely to take and questioned whether there is a valid reason for a delay yet you have not responded.

Therefore, on the basis that a non-reply after the statutory time limit has ended constitutes a refusal to provide the information requested, I have no choice but to request a review.

Please note that any response that I now receive will be taken as a response to this request for a review and if any further challenge is required it will be submitted directly to the Information Commissioner.

I have made enquiries as to the reason for the delay and the time in which you can expect a response.

I can confirm that the delay has been the result of resource issues within the department that holds the information. We appreciate that this is unsatisfactory however please be assured that we are making every effort to have a response to you as soon as possible.

Dear Information Governance,

Thank you for the partial response.

The 'Decision to Procure Memo' that you have provided is just that; a memo. It is not the formal decision to engage services which, considering the expenditure, would normally need to be made by an Executive Portfolio Holder at least. Similarly, this decision would need to include a formal decision to exempt from financial regulations seeing as there was no competitive tender.

I ask that you provide me with a full response including the above mentioned decision documents before the time limit ends for my review request which I understand would be 21 May 2010. Should I not receive a full reply by this time I will pass the matter to the Information Commissioner.

The big issue at stake here is that, if there has not been a proper decision to approve the expenditure on employing Harold Tinworth then the money has been spent unlawfully.

A search of NCC's website finds no trace of such a decision and it would appear from this response that there is none available.

Therefore, the consequences of not being able to respond fully to this request could be very serious.
