Payments for Dis-repair

We're waiting for Graham Cheadle to read a recent response and update the status.

Dear Sheffield City Council,

I wish to have details of sums of individual payments* made to all tenants for dis-repair compensation, during the period of 1/1/2009 to 1/1/2012.

*Not names and addresses, just the amounts paid per individual claim.

Many thanks for calling me earlier to clarify your Freedom of Information
request.
 
We agreed on the phone that you would like the information requested in
your initial email for the following situations:
 
- all examples of money paid though the court system in any cases of
disrepair
- all examples of money paid by Sheffield Homes/SCC to stop a case going
to court
- all examples of money paid by Sheffield Homes for any compensation to do
with disrepair issues, for example in a situation where we have taken
longer to repair something than it should have taken and we have made a
good landlord payment of £50
 
Your request has been treated as a Freedom of Information Request under
the Freedom of Information Act 2000 and has been logged as FOI0013.  The
Act states that we should respond to your request within 20 working days,
meaning that we will respond to you by 13th June.
 
I will be liaising with Sheffield City Council to provide some of the
information.

Re: Your Recent Request for Information
 
 
Please find attached the information relating to your recent Freedom of
Information Request for “details of sums of individual payments made to
all tenants for dis-repair compensation, during the period of 1/1/2009 to
1/2/2012” made on 11 May 2012 and clarified as below on 15 May 2012:-
 
1. “All examples of money paid through the court system in any cases of
disrepair”.
 
This is shown on the 2^nd page of the enclosed Excel Spreadsheet.
 
2. “All examples of money paid by Sheffield Homes/SCC to stop a case going
to court”.
 
Neither Sheffield Homes nor Sheffield City Council pay money to a claimant
to stop a case going to court.  Monies are only paid when there is a valid
claim, details of which are contained in the spreadsheets.
 
3. “All examples of money paid by Sheffield Homes for any compensation to
do with disrepair issues”.
 
The information on the first Excel spreadsheet labelled “Repairs Related
PPT” contains details of monies that have been paid by Sheffield Homes to
tenants in instances where Sheffield Homes have not carried out the
repairs within a reasonable period of time and have therefore made a
discretionary payment to the tenant for the inconvenience.
 
 
 
The lists on the spreadsheets do not contain details of credits (payments)
which are made directly to rent accounts. Sheffield Homes hold 40,714 rent
accounts for current tenants. The information requested cannot be
automatically extracted from each rent account. It would require each
account to be visually read to locate and identify such credits. This
would take between 5 and 20 mins each. At  5 mins this would constitute 91
days work by a single officer of Sheffield Homes doing nothing else but
this.
 
There are a further 21,227 rent accounts belonging to former tenants
(after 1/1/09) and this would constitute an additional 47 days work.
 
Under S. 12 of the Freedom of Information Act  a public authority does not
have to comply with a request for information if the cost of compliance
exceeds the appropriate limit, which is £450. In addition disclosure of
such further information has to be considered whether it would be in the
public interest.
 
Having considered the arguments for disclosing the further information
requested, and balancing it against the cost of obtaining the information,
the time that would be involved, that the use of an officer would be to
the detriment of their duties and therefore to the other residents, and
that the majority of the information has been provided, I have come to the
conclusion that the public interest does not justify the obtaining of this
further information.
