The yearly spend with Teasdale Group Ltd for the last 5 years is as

Please see attached a spreadsheet which lists the individual transactions
with Teasdale Group Ltd for each of the 5 years. This information is taken
from the Council’s finance system and is the most detailed breakdown
available.

 

The Council had a contract in place with Teasdale Group Ltd for Out of
Hours Highway Emergency Call Out. This accounts for approximately £50k of
the spend for the years 2008-2011 (due to the nature of emergency work,
this can only be given as an approximation). Further spend is spread
across different departments. As these individual purchases fall below the
Council’s requirements for a tender exercise (set at below £10k) they
would have been procured in line with the Council’s minor procurement path
which requires 3 quotes to be sought and a decision made on best value.

 

Please also see attached a copy of the model minor and routine Conditions
used for a contract at the value of the Out of Hours contract and the
individual minor procurements. Please note, these are the most recent
versions of these documents and may have been updated since the contract
began.

Dear Complaints Officer,

Thank you for responding to me FOI request and I accept your apologies for the delay.

I am astounded that a company has a contract with the Royal Borough of Kingston for only £50,000 per annum, x 5 = £250,000 however they have been paid over £4 million pounds.

I have read your terms and conditions also attached, advising the term of orders below £10,000. However on the excel spreadsheet I see you do not have the value of the orders, since the suppliers payments published on your website show payments to Teasdale Group Ltd to be paid numerous times over the £10,000.00 mark.

Please can you provide me with the values of each orders plus show the proof of the correct contract procedures have been carried out on the orders over £10,000 that have been issued to Teasdale Group Ltd.
Can you also publish the the excact dates works were ordered or paid (which ever is easier for you).

Can I also see some examples where the council have followed the correct procedure and did obtain the 3 quotes and not just issued the works to Teasdale Group Ltd. I do not expect to be shown every job order however the council should be able to show me the examples in the 2012-2013 years.

As a tax payer in Kingston I am very concerned how the money is being spent and concerned that correct procedures have not been followed.

Show the proof of the correct contract procedures have been carried out on

Following a sample audit of the works contracted to Teasdale, an example
of 3 quotes is provided for the Vale Road North works. Please see the
attached quotes. These have been slightly edited to uphold personal
confidentiality.

 

Due to the nature of Emergency Works, a contractor is often brought in to
resolve a small issue which is then discovered to be a larger, more costly
problem and so the price increases from the initial estimate to the end
price as listed on the attached spreadsheet. Furthermore, Emergency Works
are by nature a reactionary process requiring a fast response and so there
is a shortage of  paperwork demonstrating procurement process. This has
been highlighted as an issue and raised with the management of the
department responsible to ensure better record keeping in future.

 

Can you also publish the exact dates works were ordered or paid (which
ever is easier for you).

Dear Complaints Officer,

Thank you for responding to my FOI request, however I am dismayed at the answers and attachments.

I will respond to the 3 alternative quotes provided before I raise some additional questions.

I do not believe the 3rd quote quoting a daywork rate is a quote for the same scheme as Vale Road further more that quote was carried out 1 year before the Teasdale Group Ltd and R J Dance quote. Please provide me with the 3rd quote to show compliance to your procurement process. I would like to add the R J Dance quote seemed to be covering more work than Teasdale Group Ltd i.e. rebuilding the entire brickwall and erecting scaffolding – This was not what Teasdale Group Ltd quoted.

However with that quote provided I was pleased I could see the order number 30011915, I then cross checked this with the payments to suppliers and was dismayed to see that Teasdale Group Ltd got paid 3 times for that order.

1st on the 30th June 2011 being paid £10,036.00 – Please note this is NOT their estimate price plus more expensive that your Highway Maintenance Contractor R J Dance quote.

2nd on the 4th August 2011 being paid a staggering £36,576.00

3rd and final payment that I can locate for an additional £16,542.00p

Total Value £63,154.00 from an estimate of £8,363.66p

Question 1 – Please explain why Teasdale Group Ltd was awarded the work over R J Dance – The R J Dance quote seemed to be covering more work than Teasdale Group Ltd i.e. rebuilding the entire brickwall and erecting scaffolding – This was not what Teasdale Group Ltd quoted.

Question 2 – Please provide the proper 3rd quote for this scheme.

Question 3 - Was this additional works that were carried out amounting to £63,154.00?

Question 4 - If so, please provide me with the additional quotes that Kingston Council obtained to proceed with this additional amount of works to ensure compliance with their procurement notice. I would like to add a value over £50,000 needed to be tendered.

Question 5 - Can you confirm these works do not fall under part of Teasdale Group Ltd Out of Hours Emergency Contract, if it does please provide evidence that they are to undertake this type of works?

In my last FOI request I had asked to be shown examples from the year 2012-2013 I received none, only 1 for the 2011/2012 year (which has proved very useful!)

Question 6 – Please provide me with proof showing the correct procedure has been followed for all the orders in the financial year 2012-2013 as originally asked. Provide all 3 quotes for the works paid to Teasdale Group Ltd.

Question 7 –Please confirm Teasdale Group Ltd no longer had the contract in that year, hence no formal contract in place with the Royal Borough of Kingston upon Thames. So therefore the reason 'you cannot provide estimates because they were on the emergency works contract' is incorrect.

Question 8 – Please advise why the majority of the works carried out by Teasdale Group Ltd – i.e. ducting, bollards, Pay & Display and sign posts were not carried out by your appointed Highway Maintenance Contractor R J Dance Ltd who won the contract based on best value to the Royal Borough of Kingston upon Thames?

Question 9 - Please explain why Teasdale Group Ltd carried out land drainage works and not your drainage contractor Cappagh Contractors Construction Ltd who again were appointed based on best value to the Royal Borough if Kingston upon Thames.

Question 10 – Please advise as to whether both your term contractors know that Teasdale Group Ltd were carrying out works that they should have been doing? Losing approx 4million pounds worth of income?

Question 11 – Please advise why Teasdale Group Ltd are charging consultancy provision, please provide evidence of alternative quotes to show best value to the Royal Borough of Kingston upon Thames? Over the years there appears to be a lot of value paid to Teasdale Group Ltd.

Question 12 – Please provide evidence of every Teasdale Group Ltd invoice for carrying out Traffic Management works, this is another very high value across the years. The Royal Borough of Kingston upon Thames has advised me that they have no contracts in place. Please show me the alternative quotes for carrying out the Traffic Management – all quotes please.

Question 13 – Please confirm the company who carries out the Highway Minor Emergency Contract from 2011, please include the expenditure for the last 2 years.

Question 14 - Please can you provide me with the latest expenditure with Teasdale Group Ltd - from Jan to March 2013 - Please provide me with the 3 alternative quotes to ensure procurement compliance.

I hope this time I will be given all the correct evidence to show me that all the correct procurement procedures have been carried out, as it stands on my 2 previous requests it does not look like it has been and that is very worrying!

I acknowledge your request for information received on 9 April 2013.

 

The Council has launched a formal internal investigation which will be
undertaken by the Audit Department to consider this matter. This will
include a full review of the processes which led to works being awarded to
Teasdale Ltd and will address, as far as possible, the issues raised in
your email dated 9^th April.

 

The Council has a robust approach to procurement which is governed by our
Contract Standing Orders and Procurement Framework, which we expect all
officers to comply with. It would be inappropriate to comment further
until the outcome of the investigation is known, but if it is found that
procedures have not been followed, the Council will take swift and
decisive action. The Council has already put in place new arrangements
through the London Highways Alliance Contract for future works of this
nature.

 

This investigation is unlikely to be complete prior to the statutory
timescale of 20 working days, due to the complexity of the matters raised.
However, we will advise you of the expected timescales and scope of the
investigation within the next 5 working days and will provide you with a
response to your email of 9^th April following completion of the
investigation.

Further to your recent FOI, Kingston Council has been reviewing
information provided as part of the FOI response sent to you on 8^th March
2013.

 

I can confirm that the figures had some inaccuracies, particularly in
years 2008/9 and 2009/10. These were mainly due to duplicate lines in the
report used. The Council is reviewing how it provides information in

I refer to your email of the 9^th April and the subsequent response from
my former colleague Jason Denyer of the 23^rd April. The questions you
raised in your email have now been considered by Mehmood Khan, Street
Scene Service Manager, and a series of responses is shown on the attached
document.

We have looked closely into this case and have investigated past practices
and arrangements as far as we can.

What we have found in some instances falls far short of the robust
approach towards procurement taken by Kingston Council today and the
requirements of its Contract Standing Orders. Although there is no
suggestion of anything improper, I can confirm that the members of staff
who were managing this area at the time of the previous poor practice are
no longer with us.

We are determined to ensure that best practice is followed in the way we
manage contracts now and in the future, and the instances of previous poor
practice that we uncovered could not occur under the  new arrangements in
place (since 1 April this year) for works delivered under the London
Highways Alliance Contract. We are grateful for the scrutiny you have
brought to this area which has supported the changes we have made to
strengthen management procedures.

There has never been any question about the quality and delivery of
Teasdale’s work for us. The council is keen to support local firms such as
Teasdale to support local jobs and economic growth.
