Payment of Court Fees for Council Tax Liabilities and Transparency of Summons.

Dear Ministry of Justice,

1) Would you please inform the public, whether the Government Department has to pay the required court fee, as per the law when asking the court to take an action that require payment? For example
1)(a) How much are they require to pay when bringing a Council Tax Liability claim to the Magistrate Court

2)Would you please tell the public, whether for accountability purpose HMCTS and/or for the avoidance of fraud HMCTS keeps details of every payment that is received and the case that it is related to.?

3) Would you please tell the public whether Local Government have to comply with your response to question 1 above?
3)(a) When issuing summons for Council Tax liabilities?
3)(b) Would you kindly tell the public what payment in £, is required by law ( HMCTS) to issue a Council Tax Summons?

4) Would you please tell the public whether they are entitle to request from HMCTS details receipt of proof of payment or/and whether only the parties to the case are entitle to this information?

5) In order to prevent fraud, does the law require the MOJ and all its departments and sub-departments (e.g. HMCTS) to behave in a responsible and transparent way?

6) Would you please inform the public as to whether the CASEMAN must reflect all payments of all the court fees that have been received regarding the case?

7) Would you please inform the public whether a case brough by the Local Council for Council Tax at the MAGISTRATE COURT has any CASEMAN record.
7)(a) Is this CASEMAN available to the memberof the public or/and to parties in the case only?

8) Would you please tell the public about the law that gives authority to the Local Government, the Council to bring alleged liability for Council Tax at the MAGISTRATE COURT, rather than the County Court Money claim like any other Creditor is obliged to do.

9) Would you please tell the public what authority the Local Government has to issue Summons for Council Tax alleged liability?

10) Would you please tell the public whether Summons which are not delivered by recorded delivery or by hands has validity.

11) Would you please provide to a public an sample of a Council Tax Summon?
11)(a) Would you please provide information as to why this last can only be issued by MAGISTRATES COURT.
